Termination of Outsourcing Services: Final Reminder To Repatriate Foreign Workers In Accordance with the Government’s Decision To Terminate Outsourcing Services.

The Ministry of Home Affairs (MOHA) has decided to terminate outsourcing services for foreign workers with effect from 31st March 2019. Reference is made to the MOHA directives on management of foreign workers by outsourcing companies dated 15th October 2018, 23rd November 2018, 27th  December 2018, and 18th January 2019.

2. Outsourcing services providers and employers have until 31st March 2019 to repatriate any remaining foreign workers under outsourcing services.

3. In view of this latest policy and regulations on outsourcing services for foreign workers, companies are advised to repatriate their foreign workers with active Temporary Work Visit Pass by 15th  March 2019. The Government’s decision on the matter is final and any appeal will not be considered.

4. Foreign workers with working permits under outsourcing employers who are not involved in the process of changing of employers will be terminated through the system, following which the status of the foreign workers involved will be changed to illegal foreign workers if they still remain in Malaysia.  MOHA has advised that outsourcing employers to comply with the directive and to repatriate their foreign workers within the stipulated period to avoid prosecution under the Immigration Act 1959/1963, and the Private Employment Agency Act (Amended) 2017. MOHA will follow up with further action and enforcement activities upon expiry of the deadline on 31st March 2019.

The Immigration Department has rounded up more than 1,200 illegal foreign workers in the first three days of its Ops Mega 3.0 nationwide. Its director-general Datuk Seri Mustafar Ali said the arrests were made following the end of the rehiring programme which ended on June 30.

“We held 473 operations nationwide beginning July 1 and checked 5,038 foreigners.

“We detained 1,224 for further action,” he told reporters following the department monthly assembly here on Tuesday (July 3).

He said they had already given ample warning before the rehiring programme ended.

“From Feb 15, a total of 744,942 illegal workers and 83,919 employers had registered for the rehiring programme.

“Of the total number of illegal workers who registered, 415,791 came forward to us for the ‘whitening’ exercise,” he said, adding that they would not compromise on illegal workers and employers who flouted the law.

He said so far, legal action had been taken against 15 employers in the last three days of Ops Mega 3.0.

On the overcrowding of illegal workers at the Immigration Depots nationwide, Mustafar said his department would ensure investigations were completed within 14 days from their detention.

“The Government stands to save in administrative costs, which currently amounts to as much as RM25mil a month at these depots.

“It is better that this money be used for other purposes, such as education instead of bearing the costs of holding these illegal workers,” he added.

Malaysia Government To Ban Foreign Cooks, Only Locals Allowed To Cook In Restaurants

The Human Resource Ministry wants all restaurants in the country to only recruit locals as cooks from July 1, 2018 says its Minister M. Kulasegaran.

He however said all operators would be given up to the end of the year to ensure only local cooks work in their restaurants.

“So we want locals to be employed as cooks. There will be no compromise … we are giving you notice to do it by Dec 31. If you don’t do it we can’t help it,” he told Bernama News Channel here on Thursday.

Earlier, Kulasegaran held a meeting with the Indian Restaurant Operators Association (Prisma) in Petaling Jaya.

He said the ministry would be holding more meetings with Prisma as well as the Indian Muslim Restaurant Operators Association (Presma) soon on the implementation of local cooks in restaurants.

Kulasegaran said the move would be able to reduce dependence of local restaurants on foreign workers and ensure the quality of local food.

He said the ministry would follow the footstep of the Penang state government in banning foreigners as cooks in food shops, restaurants as well as stalls around the island.

Since 2014, the Penang state government prohibited foreigners from working as cooks at hawker stalls in an effort to protect the national food heritage.

Commenting on the statement, Prisma president P. Muthusamy said the decision was quite shocking and would have major implications to operators.

“In the past few years, we have been facing problems of manpower. In fact more than 500 restaurants had closed during the period due to the shortage of workers,” he said.

Muthusamy said he hopes the ministry would hold further discussions with food shop operators nationwide before implementing the decision.

Presma president Ayub Khan said the problem of workers in restaurants was getting more serious as no locals want to work in restaurants.

“We advertised, offering a salary of up to RM2,500, but no one came. It is not easy to find local workers for restaurants,” he said.

Muar Furniture Sector Short of 10,000 Foreign Workers

Furniture manufacturers in Johor are facing foreign labour shortage and it has caused at least 10 manufacturers in Muar to close last year, said the Federation of Johor Furniture Manufacturers and Traders Association president Koh Chon Chai. He said the problem is serious and the industry players in the state were short of 10,000 foreign workers.

“This has affected production. Some have been forced to close down,” he said on the sidelines of a trade conference.

Koh said Muar is a major furniture production base for the country and 63% of the furniture exported by Malaysia is produced in Johor.

“There are some 800 factories. We export to over 100 countries. Our export is worth about RM9.5 billion. Demand is good due to the quality of our raw materials and good design,” he said.

Koh said automation was not the solution to the labour woes.

“Our products can only fetch premium prices when we tell our customers that our furniture is handmade,” he said.

He said, the handmade requirement has become one of the obstacles for automation of the industry.

According to statistics, a total of 8,048 foreign workers were brought in for the furniture industry in 2016.

In June, in a move to help the industry, the government banned the export of rubber wood from July 1.

The Minister in the Prime Minister’s Department Datuk Seri Dr Wee Ka Siong said that the decision was made following complaints by the furniture industry and exporters that they were facing a shortage.

Wee said the country exported some RM300 million in raw rubber wood yearly to countries like Vietnam and China.

Malaysia Cabinet Agrees To Postpone Levy Payment On Foreign Workers To Next Year

The Cabinet has agreed to postpone to next year, the implementation of levy payment on Malaysia foreign workers by employers, which will be enforced under the Employer Mandatory Commitment (EMC). Transport Minister Datuk Seri Liow Tiong Lai said the Cabinet today, had also agreed to look into a proper ecosystem, aimed at providing convenience to industries in hiring foreign workers, and to ensure the country’s economic growth.

He said the decision was made after a presentation by Minister in the Prime Minister’s Department Datuk Paul Low who gave the overall picture pertaining to the EMC.

“It is not just on levy, but on the rights of the employer to have direct access towards the workers, rather than going through a middle man, how to cut down bureaucracy procedures and how to have fast employment of foreign workers.

“At the meeting, we also voiced out the need to regulate employment of foreign workers and ensure it can support our economic growth, without giving problem to our social issues,” he told reporters here today.

On Dec 31, Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi, who is also home minister, had announced employers would be responsible for paying the levy of their foreign workers which would be enforced under the EMC.

Under the scheme, the employers would be disallowed from deducting the levy from the wages of their workers.

Yesterday, construction industry players wanted the EMC to be scrapped as it did not benefit the country.

Liow said Prime Minister Datuk Seri Najib Tun Razak had agreed to look into these matter personally and would coordinate with the home ministry and human resources ministry to “take care of whatever hiccups” to resolve the issue.

“The Cabinet is clear that our foreign worker policy must be vibrant and able to solve the present shortage of foreign workers in the country,” he said, adding the Cabinet Committee on Foreign Workers would meet soon.

DPM: Malaysia Employers Themselves Have To Pay Foreign Worker Levy From Jan 1 2017

Employers will be responsible for paying the levy of their Malaysia foreign workers effective tomorrow, Jan 1, 2017, said Deputy Prime Minister Ahmad Zahid Hamidi. He said this was enforced under the Employer Mandatory Commitment (EMC) and the employers would be disallowed from deducting the levy from the wages of their workers.

ahmad_zahid_hamidiAhmad Zahid, who is also Home Minister, said the EMC was to ensure that employers were fully responsible for their workers from the time of their appointment to the time they returned to their countries.

He said in a statement that this change in policy would ensure that employers were more responsible in taking care of their workers and avert cases of foreign workers running way, changing sectors of work illegally, and overstaying and becoming illegal immigrants.

Ahmad Zahid said employers should also abide by the Guidelines on the Minimum Standard of Foreign Workers Accommodation whereby the workers would stay in accommodation provided by the employers.

The minister also said that the government would soon introduce a Letter of Undertaking that outlines the responsibilities and conditions that every employer of foreign workers would have to observe.

He said the government was also reviewing the rate of security deposit imposed on employers who brought in foreign workers.

“The existing rate was too low and ineffective as a preventive measure to ensure that employers sent back their foreign workers to their countries of origin upon termination of their contracts,” he said.

Ahmad Zahid said the recruitment of foreign workers was a privilege granted to employers to meet the manpower needs of industries and help national economic growth.

However, he said, there were employers who were not responsible for the workers they brought in and violated the provisions in the law and regulations.

Ahmad Zahid said the government had received reports that employers did not pay wages in accordance with the minimum wage, restricted the movement of foreign workers and kept their passports.

“There were instances where foreign workers ran away and the employers washed their hands of the matter and left it to the Immigration Department, police and other agencies to locate and send back the workers,” he said.

Such incidents gave room to irresponsible people to indulge in human trafficking,” he added.

Malaysia Cabinet Nod For Yearly Foreign Worker Health Check

Some 1.9 million registered Malaysia foreign workers will have to undergo annual health screening from now on. Health Minister Datuk Seri Dr S. Subramaniam said the Cabinet has approved the new policy on health screening of foreign workers.

“We have approved annual health screening for foreign workers in Malaysia from now,” he told reporters after opening the Fruits and Vegetables Eating Campaign at Malaysia Agriculture, Horticulture and Agrotourism 2016 (MAHA 2016) here Tuesday.

However, Dr Subramaniam said the policy only affects legal and registered foreign workers.

He said the screening would cover several types of communicable diseases.

He added that the problem of tackling unscreened and illegal foreign workers was not solely the responsibility of the Health Ministry but one that needed a multi-agency approach.

He noted that Sabah was concerned that the influx of illegal workers had resulted in a rise in tuberculosis cases.

At present, foreign workers are screened in their own country before arriving here and again screened three times over the first three years.

Up to 3% of the foreign worker population, or about 60,000 of them, could be medically unfit.

Ensure Malaysia Foreign Workers Carry Health Card

Besides compelling Malaysia foreign workers to undergo annual medical check-up (fomema), they should also be made to carry a special health card, stating that they had done so.

In proposing this, Mentri Besar Datuk Seri Mohamad Hasan said drastic action must be implemented to combat the spread of communicable diseases effectively.

“The authorities have been fighting hard to eliminate certain contagious diseases for decades but these are now coming back.

“One of the reasons is because we have a high number of foreign workers who come from countries with high prevalence of diseases such as cholera, tuberculosis and malaria,” he said.

Mohamad said several new cases of malaria were reported in Jelebu recently and these could be attributed to the presence of foreign wor­kers there.

He commended the Health Ministry for reintroducing a policy which made it compulsory for foreign workers to undergo annual health checks.

“We are fully supportive of the move and hope it can be implemented quickly,” he said, adding that since all documented foreign wor­kers were already required to carry the I-Kad, information on their health status should also be incorporated into it.

“The holder’s health information can be updated annually in the card as it has high technology features,” he said.

Mohamad said the authorities must take stern action against employers who refused to send their foreign workers for the check-up, including blacklisting them and ha­­ving their workers deported.

In Ipoh, state executive councillor Datuk Dr Mah Hang Soon said certain industries facing shortage of foreign workers would resort to hiring illegal foreigners.

“These workers not only pose potential health hazard to them (employers) but also to the nation.

“Employers must strive to get workers using the proper channels,” he said.

On the other hand, Assistant Minister of Public Health Datuk Dr Jerip Susil commented Malaysia foreign workers with communicable diseases will be deported.

Malaysia foreign workers who contracted HIV/AIDS, syphilis and hepatitis will be deported to their countries of origin, said Assistant Minister of Public Health Datuk Dr Jerip Susil.

At the same time, the state Health Department will continue to impose stringent health procedures for these and other communicable diseases on new intake of foreign workers before they are allowed to work in various sectors in the state, he added.

“We have been having stringent procedures for the screening of these communicable diseases such as tuberculosis (TB), malaria, HIV/AIDS and hepatitis for the new intake of foreign workers. And if they are found to be infected with HIV/AIDS, syphilis and hepatitis, they will be deported to their country of origin,” Dr Jerip told The Borneo Post here yesterday.

He, however, said those found to be carriers of malaria and TB would be treated locally and segregated.

“We have to be on high alert as the cases of both malaria and TB have been on the rise. So we need the cooperation of everyone to ensure that the diseases could be contained and controlled,” he pointed out.

Dr Jerip also stressed that local employers must send their foreign workers for health screening on a yearly basis.

“As most of these foreign workers are employed in the plantations, many plantation owners have set up their own health facilities to provide healthcare for them. On top of that, they also provide basic healthcare services to the local community as part of their corporate social responsibility (CSR),” said Dr Jerip.

On a related issue, Dr Jerip called for a multi-agency approach in tackling these deadly infectious diseases.

“To tackle deadly infectious diseases such as TB, Hepatitis B, AIDS and even malaria, there is a need for concerted efforts by all relevant agencies such as Health Department, Immigration Department, Police, Rela, the local elected representatives and the village development and security committees (JKKKs) to be involved and assist the government in tackling this menace.

“Everyone in our society must be involved in one way or another in addressing these deadly infectious diseases from getting out of control,” he said.

Most of the illegal workers are employed in plantations, construction industry, factories and some as housemaids.

Dr Jerip was commenting on news report that the Health Ministry now wanted annual health checks, which was previously mandatory, to be reinstated on foreign workers due to increasing number of them seeking treatment for chronic ailments.

It has been estimated that up to three per cent (60,000) of foreign workers in Malaysia could be medically unfit.

Presently, foreign workers are required to undergo medical check-ups (fomema) three times over a period of three years. Besides being screened first in their countries, it is compulsory for them to undergo a medical examination within a month upon arrival here.

They must then get another thorough health check before their annual permit can be renewed.

Bangladesh To Send New Foreign Workers To Malaysia

Unemployed Bangladeshis could begin finding work in Malaysia as soon as early next month, the Bangladesh Minister for Expatriate Welfare and overseas employment said Wednesday after talks in Dhaka with his counterpart from Malaysia. “Very soon, Malaysia will start recruiting Bangladesh foreign workers for its construction, plantation and manufacturing sectors,” Minister Islam’s office said in a statement released Wednesday.

Following discussions on Tuesday with Richard Riot Anak Jaem, the Malaysian Human Resources Minister, Nurul Islam told reporters that flights carrying Bangladeshi workers to Malaysia could begin in the first week of December.

“Very soon, Malaysia will start recruiting Bangladesh workers for its construction, plantation and manufacturing sectors,” Minister Islam’s office said in a statement released Wednesday.

“The Malaysian minister said they will start recruiting workers from Bangladesh very soon and the Malaysian government is keen to recruit workers from Bangladesh.”

Islam did not discuss the number of Bangladeshis who would be able to find work in Malaysia’s plantation, construction and manufacturing sectors, and Riot returned to Malaysia on Wednesday following his two-day visit without talking to reporters.

When contacted in Kuala Lumpur on Wednesday evening, Peter Dennis, Riot’s senior private secretary, declined comment, telling BenarNews that the minister would issue no statements about the meeting in Dhaka.

No agreement was signed at this week’s meeting in the Bangladeshi capital, and it was unclear whether the latest talks were a follow-up to a memorandum of understanding signed by both countries in February. Initial reports then said that Kuala Lumpur had agreed to recruit as many as 1.5 million workers from Bangladesh over the next three years for jobs in its agriculture and manufacturing sectors.

But a day after the MoU was signed, Malaysia announced a moratorium on all new arrivals of migrant workers from Bangladesh and other countries. In May, Malaysian immigration officials said that they planned to ease the hiring freeze on foreign workers on condition that employers proved that these migrants were essential to their businesses, according to a report in Malay Mail Online.

About 300,000 Bangladeshis work in Malaysia, sending about 110 billion taka (U.S. $1.4 billion) back home every year, according to government figures.

News of the latest bilateral talks in Dhaka drew jobless people to Bangladesh’s Bureau of Manpower, Employment and Training in the capital, as recruiting agencies began promising to find jobs for clients at a cost of 40,000 taka ($507) per head.

“We cannot figure out how many Bangladeshis will be able to go to Malaysia. The recruiting agencies will contact the Malaysian employers and send them, charging some 40,000 taka for each. But I think this is possible to send people [in] two weeks as our minister has stated,” Jahangir Alam, the information officer of the Expatriates’ Welfare Ministry, told BenarNews on Wednesday.

Migrant advocates concerned

Meanwhile, migrant rights groups questioned the likelihood that Bangladeshis could be employed in Malaysia so soon.

“You see how the minister’s comment impacted the unemployed and poor youths: they have started visiting recruiting agents with money. Nobody knows how it is possible to get a job in Malaysia in less than two weeks,” Syed Saiful Haque, chairman of Warbe Development Foundation, a group that advocates migrants’ rights, told BenarNews on Wednesday.

He said corrupt middlemen already were luring poor and illiterate youths and their families with promises of jobs in Malaysia in exchange for payments.

“They are going to the brokers and the agents, as the government has not made any clear-cut statement on the procedure of going to Malaysia for jobs. The middlemen will exploit the situation. They will tell each of the workers that if they do not pay them more money immediately, he will not get the job. Thus many of the people will sell their land and other valuables to manage the money for the middlemen,” Haque said.
