Setback for China Foreign Property Buyers in Malaysia

Property consultants are petrified by Prime Minister Tun Dr Mahathir Mohamad’s statement that foreigners will not be allowed to buy residential units in Forest City, one of four islands being reclaimed by Chinese developer Country Garden Holdings Co in a multi-billion venture.

Three of them said such a move would have wide-ranging negative implications for Johor and the larger property sector and how foreign companies viewed Malaysia.

Dr Mahathir said yesterday that Malaysia would not allow foreigners to buy residential units in the US$100bil (RM410bil) Forest City project in Johor.

“One thing is certain, that city that is going to be built cannot be sold to foreigners.

His comment whipped up a wave of responses from property experts and economists, warning that the new policy would have serious ramifications.

“What will happen to the value of the condos in Forest City? Who would want to rent and who can now afford to buy them off me if foreigners cannot? The majority of the current owners of Forest City are mainland Chinese and to a small extent Singaporeans. They will be bitterly disappointed,” said an industry source from Singapore.

“The group’s project at Country Garden Danga Bay will also be affected. It now faces a more daunting task of selling the balance units at Danga Bay of about 2,000 units. So, will other key Chinese developers like R&F Princess Cove and Greenland Group in Iskandar be affected?” he said.

VPC Alliance Malaysia managing director James Wong said there may be legal suits against the government and Forest City would come to a standstill. That may force Country Garden to scale down because it has invested a lot in the country with its industrial building systems factory and an international school, among other investments.

“It will impact Country Garden and Malaysia’s property sector negatively,” Wong said.

Although a lot of leeway was given to Country Garden, this is a backlash by the Malaysian government against a private sector foreign company and would send a negative message to other countries.

“Foreign buyers and other foreign companies will shy away,” Wong said.

KGV Property Consultants executive director Samuel Tan said up to a third of the first island of about 1,477 acres had been reclaimed. High-rise residential units, an international school and a hotel have already been built.

“Forest City will come to a halt with such a policy. The other developers, both local and foreign, will be fearful because many of them are essentially building for foreigners,” Tan said.

He said the SP Setia group, Eco World Development Group Bhd, and Eastern & Oriental Bhd were essentially targeting foreigners. “Singaporeans are foreigners,” he said.

Bruce Lee, an international property consultant specialising in Iskandar Malaysia from VPC Alliance Johor Baru is sanguine about the fiasco.

“Once again, two issues are important to Malaysia, namely, foreigners buying property here and Malaysia My Second Home (MM2H) are being confused. These are two separate issues. If you buy a property here, it does not mean you will automatically get a MM2H visa, or a visa to live here.

“Secondly, foreigners are allowed to buy properties within a certain pricing threshold. In Johor, any foreigner can buy properties priced RM1mil and above, landed or high-rise.

“This country is run by the rule of law, and the previous laws and regulations cannot be repudiated,” Lee said.

Country Garden Pacificview Sdn Bhd, in a statement, said like all property development projects in Malaysia, Forest City had complied with all laws and regulations with the necessary approvals to sell to foreign purchases.

Under the national land code, a foreigner or a foreign company may buy land in Malaysia subject to the prior approval of the state authorities.

“We do not issue any permanent residency or PR to foreign buyers of Forest City,” the statement said.

Socio-Economic Research Centre executive director Lee Heng Guie, when contacted, said more clarity was needed on the move.

“The announcement is lacking details – if this is to tackle high property prices, there are already measures in place for this.

“More clarity is needed to prevent negative sentiment among foreign investors.

“We also do not want to create an impression that we are targeting Chinese investors,” he said.

He added that the reaction to the announcement needed to be monitored if there was a spillover effect into other areas of investment.

He also questioned the move in relation to the MM2H programme, and questioned whether the move contradicted the programme.

According to a Bloomberg report, Chinese nationals were the largest group of participants in the programme, which allows foreigners to live in Malaysia on a long-stay visa.

It said Chinese citizens accounted for almost 30% of successful applicants since the programme was launched in 2002.

AmBank Group chief economist Anthony Dass said while there may be an impact on Chinese investment into Malaysia initially, he expected this to stabilise after a short period.

He saw it as a positive move overall, as it would benefit Malaysians in the long term.

“Foreign investors, particularly Chinese investors, may not be happy with the move, but they will ultimately have to respect the decision that has been made.

“I believe this move sends the message that Malaysia wants a level playing field for Malaysians, and not lopsided deals or properties that only foreigners can afford,” he told StarBiz.

He did not expect tourism from China to be affected, and investors interested in other Malaysian projects were unlikely to go elsewhere due to the decision on Forest City.

“In the short-term, there may be a negative ripple effect, but I don’t expect it to be significant,” he said.

On the impact on the property, Dass said it is likely that the developers would have to redesign the Forest City project, and drop prices to cater to Malaysian buyers.

“We expect a knock-on effect on prices of the property. Prices are likely to drop, and the developers may have to redesign the remaining part of the project.

“Overall, we see this as a positive move,” he said.

The Immigration Department has rounded up more than 1,200 illegal foreign workers in the first three days of its Ops Mega 3.0 nationwide. Its director-general Datuk Seri Mustafar Ali said the arrests were made following the end of the rehiring programme which ended on June 30.

“We held 473 operations nationwide beginning July 1 and checked 5,038 foreigners.

“We detained 1,224 for further action,” he told reporters following the department monthly assembly here on Tuesday (July 3).

He said they had already given ample warning before the rehiring programme ended.

“From Feb 15, a total of 744,942 illegal workers and 83,919 employers had registered for the rehiring programme.

“Of the total number of illegal workers who registered, 415,791 came forward to us for the ‘whitening’ exercise,” he said, adding that they would not compromise on illegal workers and employers who flouted the law.

He said so far, legal action had been taken against 15 employers in the last three days of Ops Mega 3.0.

On the overcrowding of illegal workers at the Immigration Depots nationwide, Mustafar said his department would ensure investigations were completed within 14 days from their detention.

“The Government stands to save in administrative costs, which currently amounts to as much as RM25mil a month at these depots.

“It is better that this money be used for other purposes, such as education instead of bearing the costs of holding these illegal workers,” he added.

Malaysia Government To Ban Foreign Cooks, Only Locals Allowed To Cook In Restaurants

The Human Resource Ministry wants all restaurants in the country to only recruit locals as cooks from July 1, 2018 says its Minister M. Kulasegaran.

He however said all operators would be given up to the end of the year to ensure only local cooks work in their restaurants.

“So we want locals to be employed as cooks. There will be no compromise … we are giving you notice to do it by Dec 31. If you don’t do it we can’t help it,” he told Bernama News Channel here on Thursday.

Earlier, Kulasegaran held a meeting with the Indian Restaurant Operators Association (Prisma) in Petaling Jaya.

He said the ministry would be holding more meetings with Prisma as well as the Indian Muslim Restaurant Operators Association (Presma) soon on the implementation of local cooks in restaurants.

Kulasegaran said the move would be able to reduce dependence of local restaurants on foreign workers and ensure the quality of local food.

He said the ministry would follow the footstep of the Penang state government in banning foreigners as cooks in food shops, restaurants as well as stalls around the island.

Since 2014, the Penang state government prohibited foreigners from working as cooks at hawker stalls in an effort to protect the national food heritage.

Commenting on the statement, Prisma president P. Muthusamy said the decision was quite shocking and would have major implications to operators.

“In the past few years, we have been facing problems of manpower. In fact more than 500 restaurants had closed during the period due to the shortage of workers,” he said.

Muthusamy said he hopes the ministry would hold further discussions with food shop operators nationwide before implementing the decision.

Presma president Ayub Khan said the problem of workers in restaurants was getting more serious as no locals want to work in restaurants.

“We advertised, offering a salary of up to RM2,500, but no one came. It is not easy to find local workers for restaurants,” he said.

First For Malaysian Employer Gets One Stroke of the Cane For Hiring Illegals Workers

An Malaysian employer was sentenced to one stroke of the rotan for hiring illegal foreign workers in Selangor, says Immigration Department director-general Datuk Seri Mustafar Ali..

He said that although the law provides for such punishment, it was never meted out in the state before.

Mustafa said the 46-year-old owner of a bakery in Subang Jaya was sentenced on Dec 12 to six months in jail and one stroke of the rotan for employing 15 illegal immigrants who did not have valid passes.

The offence under Section 55B of the Immigration Act 1959/63 provides for a fine of between RM10,000 and RM50,000 or a maximum one year in jail or both for each illegal immigrant employed.

 “With this first case, we hope it will serve as a deterrent to employers from hiring illegal foreign workers,” Mustafar told the press after opening the state-level Immigration Day celebration here Thursday.

Mustafar also called on employers who have registered for the illegal foreign workers rehiring programme but have yet to complete the application process to come forward before the June 30 deadline.

“They can come to any Immigration office to complete the application process, including having their biometric verification done so that temporary work permits can be issued to their workers,” he said.

He said so far, a total of 630,000 illegal foreign workers and 55,000 employers have been registered under the rehiring programme, conducted between February and December last year.

However, only 233,000 applications were complete for further processing while the rest still need further action from the employers.

“Employers who no longer need the services of their foreign workers can send them to the department to be deported to their respective countries,” he said.

He added that the workers could also surrender themselves for deportation.

11,500 illegal foreign workers and 272 employers have been detained nationwide as part of a continuous operation conducted since the end of the E-card programme deadline on June 30. Firmer punishment, including whipping, awaits Malaysian employers who hire or give refuge to illegal foreign workers.

Immigration Department director-general Datuk Seri Mustafar Ali said he recently met with Chief Justice Tun Md Raus Sharif to discuss the punishments to be meted out to employers who commit immigration offences.

“I have discussed (the judicial issues) with the Chief Justice, and he expressed his readiness (to mete out) the punishments, including whipping, to employers who are still stubborn,” he said.

Mustafar revealed this after leading a team of 39 officers and Department members on an operation to detain illegal foreigners at two construction sites here and in Kamunting. The operation began last night and ended early this morning.

Mustafar added that his Department will also punish employers who protect illegal foreign workers by freezing company assets.

As of 11.30pm last night, he said 11,500 illegal foreign workers and 272 employers have been detained nationwide as part of a continuous operation conducted since the end of the E-card programme deadline on June 30.

Last night’s operation started at 10.30pm and saw 139 foreign workers checked and 45 detained for not having valid travel documents and misusing their employee passes.

“In this operation, 39 men, six women and two children, aged 1 month and 3, were detained and brought to the Ipoh Immigration Department for documentation, before being taken to the Langkap Immigration Depot for further investigation,” he said.

Mustafar also requested the cooperation of employers and local authorities on monitoring the construction of “rumah kongsi” in Taiping, which are deemed unsafe for habitation.

“On our side, there is no compromise with illegal foreign workers and we will continue conducting operations. But in terms of the safety of (legal) foreign workers, local authorities are looking into the aspects of their residential locations.

“For example, at ongoing construction sites, developers must prepare “rumah kongsi” (that meet minimum safety requirements),” he said.

Muar Furniture Sector Short of 10,000 Foreign Workers

Furniture manufacturers in Johor are facing foreign labour shortage and it has caused at least 10 manufacturers in Muar to close last year, said the Federation of Johor Furniture Manufacturers and Traders Association president Koh Chon Chai. He said the problem is serious and the industry players in the state were short of 10,000 foreign workers.

“This has affected production. Some have been forced to close down,” he said on the sidelines of a trade conference.

Koh said Muar is a major furniture production base for the country and 63% of the furniture exported by Malaysia is produced in Johor.

“There are some 800 factories. We export to over 100 countries. Our export is worth about RM9.5 billion. Demand is good due to the quality of our raw materials and good design,” he said.

Koh said automation was not the solution to the labour woes.

“Our products can only fetch premium prices when we tell our customers that our furniture is handmade,” he said.

He said, the handmade requirement has become one of the obstacles for automation of the industry.

According to statistics, a total of 8,048 foreign workers were brought in for the furniture industry in 2016.

In June, in a move to help the industry, the government banned the export of rubber wood from July 1.

The Minister in the Prime Minister’s Department Datuk Seri Dr Wee Ka Siong said that the decision was made following complaints by the furniture industry and exporters that they were facing a shortage.

Wee said the country exported some RM300 million in raw rubber wood yearly to countries like Vietnam and China.

Pleas to extend the 3-plus-1 and rehiring programme introduced by the Immigration department for foreign workers will not be entertained when it ends on Dec 31 2017. Director-general Datuk Seri Mustafar Ali stressed employers or immigrants working in the country should not wait until its too late.

“I’m stressing again that there will not be any extension and enforcement will be carried out forcefully to detain those who failed to register,” he said after attending the department’s monthly assembly here today.

This is how the department did to the Enforcement Card or E-card registration programme which was not extended when it expired on June 30, he said.

He stressed ‘Ops Mega’ which was carried out to track down and detain employers and illegal workers who failed to obtain the E-card, will be continued everyday even after Dec 31.

“We will not stop until we register every foreign worker in the country,” he added.

Employers and foreign workers who wished to stay on work in Malaysia must take the registration drive seriously.

“They (illegal foreign workers) must know the consequences of being detained and sent back. Foreign workers will be blacklisted from returning to the country again,” he added.

The rehiring programme was introduced last year when the government had decided to stop the recruitment of new foreign workers.

Illegal foreign workers however can seek to get themselves legalised under the programme which began on Feb 15 2016.

The 3-plus-1 programme, on the other hand is a voluntarily surrendering of illegal workers.

Those who surrendered would be charged a penalty of RM400 instead of paying up to RM5,000 if they were caught by the authorities, Mustafar said.

“Under our 3-Plus-1 programme, they will need to pay a fine of RM400, then buy an air ticket and return to their countries of origin.

“They will also be given a blacklist period which can be up to five years from entering Malaysia,” he added.

Mustafar also said he would meeting the Chief Justice and representatives from Attorney-general Chamber to impose stricter penalties for employers and illegal workers.

The Malaysian authorities have detained more Bangladeshis in a drive on a market at Jalan Silang in Kuala Lumpur conducted as part of the ongoing crackdown on illegal immigrants.

The market is known as ‘Bangla Market’ as it is frequented mostly by Bangladeshi workers living in Kuala Lumpur.

A Bangladeshi businessman in the area said the number of detained Bangladeshis would be 50 to 60, including some women.

Malaysian departments of immigration and customs and Kula Lumpur City Corporation jointly conducted the raid for around two and a half hours from 12pm on Saturday.

Kota Roya Bangladeshi Traders’ Association President Rashed Badal told bdnews24.com that the authorities checked whether the businesses at the market were following the laws.

“They have warned us against employing illegal immigrants,” he said.

“They detained 50 to 60 Bangladeshi customers during the drive,” he added.

The Bangladesh High Commission in Kuala Lumpur, however, could not confirm how many Bangladeshis were detained in the raid.

After hundreds of Bangladeshis were detained in the crackdown on illegal immigrants in Malaysia last month, Bangladesh Expatriates’ Welfare and Overseas Employment Minister Nurul Islam said on July 16 that “Malaysia has suspended the crackdown because of the Bangladesh government’s initiative.”

Bangladeshis made up nearly half of the 1,035 foreign nationals detained on July 1, the first day of Malaysia’s crackdown on illegal immigration, according to the local media.

The detainees did not have the necessary enforcement card (e-card) or permits for temporary residence or work, authorities said.

Malaysia’s immigration department had accepted applications for e-cards for four months until Jun 30.

During this time, 26,957 companies applied for e-cards for 155,650 workers from 15 countries.

The majority of applicants were Bangladeshis totalling 71,903.

The Bangladesh High Commission earlier said the e-card grants permission to stay until Feb 15 next year.

This means that those without a valid passport or permission to work may stay and work in Malaysia until Feb 14.

It is possible for the foreign nationals with e-cards to obtain passports and travel documents from their embassies for a new work permit within that time.

Malaysian authorities have warned that those who stay past the deadline will be deported.

According to The Sun Daily, over 600,000 illegal immigrants live in Malaysia, and only 23 percent of them have received e-cards.

Malaysia UNHCR Cardholders Given Until Sept 30 To Get MyRC Card

Kuala Lumpur – About 150,000 United Nations High Commissioner for Refugees (UNHCR) cardholders in Malaysia have until Sept 30 to apply for the special MyRC identity card issued by the Ministry of Home Affairs after registering under the Tracking Refugees Information System (TRIS).

As such, Deputy Home Minister Datuk Nur Jazlan Mohamed said refugees currently in the country were encouraged to input their biometric data under the new TRIS to ensure the government had the updated and extensive data on them.

To date, only 321 UNHCR refugees have registered to get the MyRC, comprising Myanmar nationals (98 per cent), Pakistanis (1.25 per cent) and Sri Lankans (0.31 per cent), he said.

unhcr-logoNur Jazlan said the MyRC initiative was implemented under the ‘Proof of Concept’ (POC)’ programme on April 1. He said the POC programme would enable the government to have information and biometric data of refugees and asylum seekers, who are currently in the UNHCR database.

At the end of the registration process, all the refugees would be issued a MyRC card with 21 security features that become the identity of the cardholder.

The card would contain their personal information and biometric data that are kept in a database for monitoring purposes and this would allow authorities like the Police and Immigration Department, to easily identify UNHCR cardholders.

“We want to ensure these refugees are protected. When they have a card with their biometric data, the government will have their records. Local authorities will respect this card, and refugees won’t be subjected to abuse by those who want to take advantage of their refugee status,” he said.

“They don’t have to worry, their status as refugees will continue to be maintained and respected by the government despite being registered under the system,” he told reporters after visiting the TRIS Centre in Bangsar today.

The TRIS Centre in Tower 5 Avenue 5 in Bangsar is open daily except Saturday and Sunday and public holidays from 8am to 4pm.
