移民局连续两晚在布城IOI城市购物广场内的美食中心扫荡逾200名非法外劳后,在缺乏人手清理下,造成该美食中心的运作受影响,卫生情况也变得恶劣。该美食中心是坐落在该广场的2楼,可以看到肮脏的碗碟和未清理的餐具,散落在该美食中心的入口处。据报道,尽管卫生欠佳,还是有不少的顾客到美食中心用餐。

一名不愿透露姓名的工人表示,当局检举非法外劳,造成美食档口员工短缺,已影响到中心的档口运作及清洁问题。

负责清理与打扫的外劳,一个接一个排好队被带走。

她说,尤其目前是学校假期,中心只剩下一小部分的劳力,难以应付前来光顾的人潮。

她认为,移民局在检举行动时,不应把外劳带走,他们可以发出罚单或警告。

“美食中心一向保持清洁与卫生,不曾发生堆满碗碟及餐具未清理的问题。”

她说,几乎所有负责清理与打扫的外劳都被执法当局带走。

顾客等得不耐烦
另一名工人说,由于人手不足,光顾的顾客必须等待比较长久的时间,让工人清理后,才能够坐下用餐。

“食档也缺乏工人,定购食物的服务也怠慢下来,让顾客等的很不耐烦。”

据报道,移民局本周三在该广场逮捕了逾200名来自印尼、缅甸及本来孟加拉的非法外劳,这些外劳全扣留在武吉加里尔移民局扣留营。

内政部副部长马希尔说,这些非法外劳触犯了数项条例,包括滥用旅游签证、逾期逗留及没有合法证件。

A food court at IOI City Mall appears to have been badly affected after Immigration Department rounded up more than 200 illegal foreign workers two nights ago. Dirty plates and cutlery were seen scattered on tables in the mall’s Food Junction, a food court located on the second floor. Customers were seen having their meals despite the unhygienic condition of the outlet.

A worker, who did not want to be named, said the lack of workers had affected the stalls.

“It is the school holiday season and we are left to handle a bigger crowd with a smaller workforce,” she said.

“It is unfair to us as they should have issued them summonses or warnings instead of taking them away.”

She said the used plates lying about was an unusual scene as the food court was always kept clean and tidy.

“Almost all the cleaners were taken away during the raid and they (the authorities) should at least send them back to avoid a situation like this,” she said.

Another worker said customers had to wait a bit longer to be seated because the tables were messy.

“The food orders were also taking a bit longer to be served which left customers frustrated,” he said.

“Customers could be seen waiting for tables to be cleaned and this is something which never happens.”

Bernama reported that more than 200 illegal workers from Indonesia, Myanmar and Bangladesh were arrested and sent to the Bukit Jalil immigration detention depot for further investigations on Wednesday night.

Deputy Home Minister Datuk Masir Kujat had said the illegal workers were held for various offences such as abusing their social visit passes, overstaying and not having identification documents.

IOI City Mall declined to comment when contacted by Malay Mail yesterday.

Nur Jazlan Receives Whatsapp Scam Message About Himself

It was a case of guerilla marketting gone wrong. A company, which sent spam WhatsApp messages claiming to have been endorsed by the Immigration Department to help illegal foreign workers obtain valid work permits, shot themselves in the foot after their offer reached the phone of the Deputy Home Minister himself.

The Ministry now intends to investigate and shut down the so-called rehiring company, said Datuk Nur Jazlan Mohamed (pic).

“I don’t remember endorsing them,” he said outside the Parliament lobby, Tuesday.

In the message the company, Juang Global, claimed that it had been given “advantages” by the Ministry that was better than other companies chosen for its amnesty rehiring programme that would allow employers to legalise unregistered foreign workers.

The company claims that it would slash the hefty compounds imposed by the programme if employers registered with it and also claimed customers would not need to worry about “Immigration bottlenecks”.

The message said that its programme was opened to all foreign nationalities except those from Africa.

“We will be making a police report against this company and will investigate how many foreigners have been duped by this scheme.

“I want to alert employers and foreign workers that othe only companies mandated for this rehiring programme are Bukti Megah Sdn Bhd, International Marketing and Net Resources Sdn Bhd (Iman) and MyEG,” Nur Jazlan said.

The Ministry’s rehiring programme began earlier this year and now even allows workers to register online.

The programme is aimed at giving them a chance to obtain valid work permits to meet labour demands in specific sectors and would enable the Government to know the number of illegal foreign workers in the country for monitoring and security purposes.

Nur Jazlan said from February 15 to  March 10, 15, 822 foreign workers had applied to be legalised under the programme. Majority of them are from Indonesia, Bangladesh and Myanmar.

Despite that, the Ministry views the response to this programme to be lacklustre.

Nur Jazlan had faulted weak enforcement from the Immigration Department as the reason why employers were not responding to the programme.

In response, the Ministry decided to shorten the deadline to June 30 with the promise that the book would be thrown to employers that are found to still be hiring illegal foreigners after the deadline.

Those found flouting this may be fined up to RM50,000, two-years jail or both, if convicted under Section 55(B) of the Immigration Act.

On top of that, employers who are caught with more than five illegal foreign workers face between six months to five years jail, and up to six strokes of the rotan.

內政部宣佈,政府將把重聘外勞計劃的限期從12月31日縮短至6月30日在2020年11月16 日开跑,該部呼吁僱主把握時間,為非法外勞進行登記,否則政府將毫不猶豫採取法律行動。內政部今日發文告說,為15個外勞來源國的非法外勞展開重聘計劃,已在線上(online)啟動。

從2月15日至3月10日,共有1萬5822名非法外勞在重聘計劃下進行登記,當中有9738名印尼人、3808名孟加拉人、425名緬甸人及1851名其他國籍人士。

根據內政部的評估,儘管重聘計劃展開約1個月,加上移民局頻密展開大型執法行動,重聘計劃的反應依然處於不滿意水平;換言之,還有很多僱主聘請非法外勞。

鑑此,政府呼吁僱主把握機會,參與重聘計劃,讓非法外勞獲得合法的工作准證。

內政部警告,僱主若繼續僱用非法外勞,將受到法律對付。

副首相拿督斯里阿末扎希指出,內阁週五(11日)决定,即日起冻结从国外输入外劳,惟此措施並不影响家庭女佣。他表示,任何想聘请外劳的雇主,可以聘请原有已在我国,包括工作准证过期的外劳,同时雇主也可以雇用没有任何合法文件,或还没有在6P漂白计划下登记的外劳,並將之合法化。

阿末扎希也是峇眼拿督国会议员兼內政部长,他週六在选区颁发委任状予村长后,向记者这么表示。

阿末扎希指出,政府已允准雇主在今年6月30日前,將国內的非法外劳合法化,並把合法期限从去年12月31日推迟至今年中,可惜却有一些雇主仍没有把握政府提供的机会。

他强调,政府不会手软对付那些贩卖及窝藏非法外劳者,涉及者一旦罪成,將面对鞭笞。

阿末扎希提醒,在2007年反人口贩卖及移民法令及1959/63年移民法令下,涉及贩卖及窝藏非法外劳者,一旦罪成,可面对鞭刑。

他指出,过去庇护或僱用非法外劳的僱主与代理只被罚款,並无法减少国內的非法外劳问题,因此法庭如今可对违法者施予鞭笞。

他说,隨著政府冻结引进外劳后,政府早前计划引进150万名孟加拉籍外劳的计划也正式搁置。

他讥讽,如果雇主仍然找不到员工,与其批评及向政府施压,他们应求助大马僱主联合会、大马厂商公会及大马职工总会寻找本地人代劳,所以接下来就看雇主和代理如何处理这些问题。

大马与孟加拉政府是在2月18日签署协议,双方同意在3年內分批將150万名孟加拉外劳引进我国,然而此措施遭到各界,包括僱主联合会及职工总会的反对。此外,全国副警察总长拿督斯里诺拉昔也指,引进大批外劳將导致罪案增加。

接著,阿末扎希于2月20日宣布暂时搁置引进孟加拉外劳的措施,而內政部更于隔日展开大规模非法外劳取缔行动,隨后也表示將按照各领域的需求输入外劳。

Rehiring program updates: The rehiring of illegals foreign worker programme deadline has been revised to Dec 31 2017 due to the poor response from employers. The Home Ministry in a statement said the deadline has been shortened as employers were not responsive to the programme.

“Based on our studies, although the programme has been implemented for almost a month with massive enforcement operations conducted by the Immigration Department, the programme is still at unsatisfactory level as many employers were found to hire illegal foreigners.

“Therefore, the employers are urged to take this opportunity to take part in the programme to enable their illegal foreign workers to obtain valid work permit.

“The government will not hesitate to take legal action against employers who hire illegal foreigners in line with Section 55 (B) of Immigration Act 1959/63,” it said in a statement.

Under the act, those who hire illegal workers are liable to a maximum RM50,000 fine, a maximum jail term of 12 months, or both, for each illegal employee.

In addition, any employers who hire more than five illegal workers will be jailed between six months and five years, and receive up to six strokes of the rotan, if convicted.

The ministry said a total of 15,822 foreign workers were registered under the rehiring programme from Feb 15 to March 10. From the total number, 9,738 were Indonesians, 3,808 Bangladeshis, 425 from Myanmar and 1,851 were from other countries.

The Cabinet has decided to halt the recruitment of new foreign workers supply into the country, said Datuk Seri Ahmad Zahid Hamidi. The Deputy Prime Minister said this also meant that the initial plan to bring in 1.5 million Bangladeshi workers was officially scrapped. The decision would not involve the domestic help or maid sector.

However, the decision, which was made at a Cabinet meeting on Friday, would not involve the domestic help or maid sector, according to Deputy Prime Minister Ahmad Zahid Hamidi.

Employers who wanted to hire foreign workers should recruit the existing foreign employees in the country, including those whose permits had expired, he added.

This also meant that the country’s initial plan to bring in 1.5 million Bangladeshi workers would be “closed”.

Employers or agents found guilty of protecting illegal foreign workers will be subjected to whipping. “Whipping will be meted out by courts because the punishment with fine has no effect as employers and agents still keep bringing in illegal foreign workers,” said Ahmad Zahid.

He also added that the sentence was meant to dismiss the false allegation that the government was trying to make a profit out of the recruitment process. The government had given ample opportunities for employees to register their foreign workers, he said.

Employers have until Jun 30 to legalise foreign workers. Those who want to hire foreign workers should submit their applications to the Malaysian Employers Federation, Malaysian Trades Union Congress and the Federation of Malaysian Manufacturers, added Ahmad Zahid.

Ahmad Zahid said following this, employers and recruitment agents would be dealt with more severely.

“We will be pushing for those found guilty of trafficking and harbouring illegal workers to be caned.

“Right now, they are not afraid because they think they can get away by paying a fine but that will not be the case anymore,” he said.

Employers found not registering illegal foreign workers under the Malaysia Illegal Immigrants Rehiring and Relocation Programme will be charged in court. Deputy Home Minister Datuk Nur Jazlan Mohamed said court action would be taken against employers if they were detained by immigration enforcement.

“Under the programme, if employers did not register their workers and if the Immigration Department on enforcement campaign catch them, we will straight away charge them in court.

“There will be no more compounds imposed, in fact irresponsible employers will be brought to court and will face jail term if necessary,” he told reporters, here Wednesday.

Nur Jazlan also advised employers not to wait till the last minute to register their workers.

“Register as soon as possible, it will relieve them (employers) from any responsibility when enforcement officers make their rounds,” he said and added that so far more than 2,000 employers and 12,000 illegal immigrants had registered under the programme.

The programme implemented online was aimed at giving illegal immigrants working illegally in the country to obtain valid work permit in the required employment sectors.

He also directed the Immigration Department to launch operations and raids at shopping centres flooded with illegal immigrants especially in retailing premises and restaurants in the Klang Valley, Penang and Johor.

On employers victimising their workers, Nur Jazlan said they would face action under the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act (ATIPSOM) 2007.

“For example if the employers agreed to pay salaries and did not comply with the condition causing the foreign workers to run away, their employers can be charged under ATIPSOM 2007. There is a specific clause which enabled employers to be charged,” he said.

马六甲移民局今日到吉里望一个建筑工地取缔非法外劳,一轮检查之后,91名外劳只有18名没有抵触条例,可以留下继续工作,73名被带走。移民局是在早上10时左右,与国民登记局及国家反毒机构一同展开行动,他们到达时,其中3名外劳不顾生命危险跳下工地旁一条流向马六甲海峡的小河潜逃,但都被捉回。

今早的取缔行动是由该局局长弗兹率领,随行官员还有执法组主任南沙、副主席莫哈末沙比里。弗兹说,今次的取缔行动中,有73名外劳因抵触条例而当场被逮捕,并将带返移民局展开深入调查。“被捕的73名外劳中有71名男性和2名女性,他们分别来自印尼、孟加拉、印度、缅甸及尼泊尔;此外,有2名本地男子涉嫌包庇及雇用抵触1963年移民局法令第39b条文(滥用签证)、1959/63年移民局法令第6(1)(c)条文(非法入境)和15(1)(c)条文(逾期逗留)。

跳河逃走游半公里外劳最终落网
其中一名孟加拉外劳为逃避移民局的取缔,拼命逃跑,包括跳入河中游泳至少半公里,上岸后继续奔跑老远与躲藏,但还是落网。由于该河流曾有鳄鱼出没,执法员不敢掉以轻心,只能站在岸上追缉,包括透过一名渔夫协助,以小船阻挡外劳继续潜游。该名外劳较后趁渔夫不注意游上岸,再往填海区跑去,与在场约5名负责围捕的执法员展开约半公里追逐后,最终在草丛中遭执法员制伏及逮捕。

Freeze On Foreign Workers’ Intake Will Impact Projects

Putrajaya’s suspension of foreign workers’ intake will exacerbate the shortage of manpower problem in the construction industry, which will cause delays in project completion, warned the Master Builders Association Malaysia (MBAM).

MBAM, the umbrella organisation that represents the Malaysian construction industry, estimated that the industry needs at least 1.995 million on-site foreign workers by 2020, up a whopping 823,000 or 70.2% from 1.172 million last year.

In a country with a population of 31 million and an unemployment rate of about 3%, Malaysia’s construction industry needs foreign workers supplies to fill the manpower gap, especially since locals are not keen on working in the construction industry, said MBAM president Matthew Tee.

“There should be a realistic understanding that our industry needs foreign workers. We employ them because even if the unemployment rate somehow managed to reach 0%, meaning everyone in the local labour force is employed, there will still be demand-supply gap for manpower in the construction industry,” Tee told The Edge Financial Daily in a recent interview.

Tee opined that if the government insists on suspending the recruitment of foreign workers, the construction industry will be hit, as builders will face difficulty in filling the demand-supply gap. Eventually, delivery time and cost of many projects will be affected.

“For now, contractors can still deliver existing projects with the available manpower. But in the medium-to long-term, when all new mega projects, be it MRT2, LRT3, KL118 or Kedah’s Rubber City, are launched and implemented in full, we will still find it difficult to source for labour if the decision to suspend the intake of foreign workers is not reversed,” he stressed.

foreign workers supply in malaysiaTee’s statements came following the announcement on Feb 19 by Home Minister Datuk Seri Dr Ahmad Zahid Hamidi that the government had decided to suspend the recruitment of all foreign workers to Malaysia.

Urging employers to recruit local workers, Ahmad Zahid had said the freeze would allow the government to review the two-tier levy system for foreign workers, while existing illegal workers in Malaysia would be detained and deported.

The freeze came after some non-governmental organisations protested a reported intake of 1.5 million workers from Bangladesh over the next three years, which the government earlier said was to meet demands of industries.

Human Resources Minister Datuk Seri Richard Riot Jaem had clarified that the agreement inked with Bangladesh’s government would allow 1.5 million Bangladeshis registered to seek work overseas to find jobs in Malaysia — that it didn’t mean all 1.5 million of them will make their way to Malaysia.

Meanwhile, MBAM hopes to meet with Ahmad Zahid to voice the association’s concern about the sudden ban, and to offer some solutions. In MBAM’s estimation, 36% of construction workers are illegal foreign workers, 19% are legal, while the remaining 45% are locals.

“To be honest, we are caught in a dilemma. We use our resources to train these foreign workers and some of them are highly productive, so why send them back?”

“If more locals are interested to join the industry, and the process of getting legal foreign workers can be made more efficient, I believe the issue of illegal foreign workers can be significantly minimised,” said Tee.

Tee reiterated that MBAM supports the government’s effort to bring in more foreign workers, but opined that the country shouldn’t over-rely on one single source country — in this case Bangladesh — adding that the rehiring process should be made as efficient as possible.

“It should not be too much of a burden for employers and their workers in terms of time and money,” he said, adding that some contractors may resort to employing illegals to complete their projects on time and within budget.

As to the hike in foreign worker levy — originally meant to take place in February, but has since been deferred pending discussions with businesses after strong opposition to the move — Tee said the hike should be rescinded, as the new rates are not reflective of the current economic situation.

“Employers are already feeling the pinch from the weakening ringgit, implementation of goods and services tax, and the minimum wage policy. We think the 100% increase in levy [for construction sector] is just too much,” he said.
