The Immigration Department has rounded up more than 1,200 illegal foreign workers in the first three days of its Ops Mega 3.0 nationwide. Its director-general Datuk Seri Mustafar Ali said the arrests were made following the end of the rehiring programme which ended on June 30.

“We held 473 operations nationwide beginning July 1 and checked 5,038 foreigners.

“We detained 1,224 for further action,” he told reporters following the department monthly assembly here on Tuesday (July 3).

He said they had already given ample warning before the rehiring programme ended.

“From Feb 15, a total of 744,942 illegal workers and 83,919 employers had registered for the rehiring programme.

“Of the total number of illegal workers who registered, 415,791 came forward to us for the ‘whitening’ exercise,” he said, adding that they would not compromise on illegal workers and employers who flouted the law.

He said so far, legal action had been taken against 15 employers in the last three days of Ops Mega 3.0.

On the overcrowding of illegal workers at the Immigration Depots nationwide, Mustafar said his department would ensure investigations were completed within 14 days from their detention.

“The Government stands to save in administrative costs, which currently amounts to as much as RM25mil a month at these depots.

“It is better that this money be used for other purposes, such as education instead of bearing the costs of holding these illegal workers,” he added.

Pleas to extend the 3-plus-1 and rehiring programme introduced by the Immigration department for foreign workers will not be entertained when it ends on Dec 31 2017. Director-general Datuk Seri Mustafar Ali stressed employers or immigrants working in the country should not wait until its too late.

“I’m stressing again that there will not be any extension and enforcement will be carried out forcefully to detain those who failed to register,” he said after attending the department’s monthly assembly here today.

This is how the department did to the Enforcement Card or E-card registration programme which was not extended when it expired on June 30, he said.

He stressed ‘Ops Mega’ which was carried out to track down and detain employers and illegal workers who failed to obtain the E-card, will be continued everyday even after Dec 31.

“We will not stop until we register every foreign worker in the country,” he added.

Employers and foreign workers who wished to stay on work in Malaysia must take the registration drive seriously.

“They (illegal foreign workers) must know the consequences of being detained and sent back. Foreign workers will be blacklisted from returning to the country again,” he added.

The rehiring programme was introduced last year when the government had decided to stop the recruitment of new foreign workers.

Illegal foreign workers however can seek to get themselves legalised under the programme which began on Feb 15 2016.

The 3-plus-1 programme, on the other hand is a voluntarily surrendering of illegal workers.

Those who surrendered would be charged a penalty of RM400 instead of paying up to RM5,000 if they were caught by the authorities, Mustafar said.

“Under our 3-Plus-1 programme, they will need to pay a fine of RM400, then buy an air ticket and return to their countries of origin.

“They will also be given a blacklist period which can be up to five years from entering Malaysia,” he added.

Mustafar also said he would meeting the Chief Justice and representatives from Attorney-general Chamber to impose stricter penalties for employers and illegal workers.

The Malaysian authorities have detained more Bangladeshis in a drive on a market at Jalan Silang in Kuala Lumpur conducted as part of the ongoing crackdown on illegal immigrants.

The market is known as ‘Bangla Market’ as it is frequented mostly by Bangladeshi workers living in Kuala Lumpur.

A Bangladeshi businessman in the area said the number of detained Bangladeshis would be 50 to 60, including some women.

Malaysian departments of immigration and customs and Kula Lumpur City Corporation jointly conducted the raid for around two and a half hours from 12pm on Saturday.

Kota Roya Bangladeshi Traders’ Association President Rashed Badal told bdnews24.com that the authorities checked whether the businesses at the market were following the laws.

“They have warned us against employing illegal immigrants,” he said.

“They detained 50 to 60 Bangladeshi customers during the drive,” he added.

The Bangladesh High Commission in Kuala Lumpur, however, could not confirm how many Bangladeshis were detained in the raid.

After hundreds of Bangladeshis were detained in the crackdown on illegal immigrants in Malaysia last month, Bangladesh Expatriates’ Welfare and Overseas Employment Minister Nurul Islam said on July 16 that “Malaysia has suspended the crackdown because of the Bangladesh government’s initiative.”

Bangladeshis made up nearly half of the 1,035 foreign nationals detained on July 1, the first day of Malaysia’s crackdown on illegal immigration, according to the local media.

The detainees did not have the necessary enforcement card (e-card) or permits for temporary residence or work, authorities said.

Malaysia’s immigration department had accepted applications for e-cards for four months until Jun 30.

During this time, 26,957 companies applied for e-cards for 155,650 workers from 15 countries.

The majority of applicants were Bangladeshis totalling 71,903.

The Bangladesh High Commission earlier said the e-card grants permission to stay until Feb 15 next year.

This means that those without a valid passport or permission to work may stay and work in Malaysia until Feb 14.

It is possible for the foreign nationals with e-cards to obtain passports and travel documents from their embassies for a new work permit within that time.

Malaysian authorities have warned that those who stay past the deadline will be deported.

According to The Sun Daily, over 600,000 illegal immigrants live in Malaysia, and only 23 percent of them have received e-cards.

Malaysia Illegal Foreign Worker Issue Needs Intervention

The announcement by the Malaysia Immigration Department on Tuesday that it would freeze the assets and bank accounts of employers hiring illegal foreign workers has been described as costly and complicated for the business community. This description indicates the severity and unpopularity of this latest decision among business owners. Among the key economic sectors to be affected most by this decision could be plantations, construction, service and manufacturing.

Technically, there is full employment for Malaysians and there is definitely a shortage of labour.

To be enforced next month, this Immigration Department decision has stirred up a huge furore among almost all trade groups, including the Federation of Malaysian Manufacturers and the Associated Chinese Chambers of Commerce and Industry of Malaysia (ACCCIM).

It seems like a hasty and harsh move threatening to shatter the private sector that has helped the country to build up its economy.

Business operators feel that it is the country’s economy that stands to lose if the decision is not reversed.

“There is a necessity for foreign workers in our country, but the system to hire legal workers is costly and complicated,” said lawyer Michael Chai, deputy secretary general II of the ACCCIM.

“The way to resolve it is not to throw a nuclear bomb at the industry.”

Datuk Michael Kang, president of the SME Association of Malaysia, told Nanyang Siang Pau that about 80% of local SMEs will be wiped out if this decision is enforced as almost 80% of local SMEs hire illegal foreigners.

There are about 650,000 SMEs in the country and they form more than 90% of the companies registered in Malaysia.

Kang told The Star: “The Government should legalise all illegal workers. All legal and illegal workers should go for fingerprint imaging so as to monitor them.”

The issue of foreign workers is an age-old problem plaguing the country.

The Government wants Malaysia to be free of illegal immigrants by 2020 and aims to bring down the percentage of foreign labour in the workforce to 15%.
According to ACCCIM deputy secretary-general I Tan Sri Teo Chiang Kok, illegal labourers in Malaysia now total 3.5 million compared with Malaysia’s total population of more than 30 million.

Teo said if the system for the industries to bring in legal foreign workers was easy, the issue of illegal labour would have to be solved “once and for all”.

If we look back, the Government has rolled out many measures to tackle the problem.

Fresh in our minds are the 6P Programme, the “whitening” of illegal migrant workers, and the suspension of recruitment of all foreign workers (which has since been lifted for manufacturing, construction, plantation and furniture-making industries).

With this latest announcement by Immigration, it is clear that the illegal labour issue has yet to be resolved.

The Immigration Department’s decision is yet another knee-jerk policy that only treats the symptoms but not the root cause of the problem, according to Teo, who is involved in property development.

“A lot of times the Government is just putting obstacles and using threatening methods (on us). This is not the way to address the pro­blem,” he said at an ACCCIM press conference on Thursday.

Industry players say they always prefer local and legal workers, given the option.

If the Government’s strategy is to push employers to hire more locals, the current unemployment rate of 3.3% is technically considered full employment.

“This means that there are just not enough local workers to meet the labour demand in our economy,” said Teo.

Indeed, this may not be the right time for the Government to push hard for automation as many SMEs are not prepared amid weak economic conditions.

datuk-ter-leong-yapAccording to the latest survey conducted by ACCCIM on the economic situation of Malaysia for the first half of the year, a total of 14.1% of the respondents were eager to give automation a try to address the difficulty in hiring foreign labour.

However, they said capital shortage, lack of technical know-how and the limitation of a small market in Malaysia were obstacles.

“I believe one day our country will move towards that direction, but we seriously require time.

“We need a good blueprint on the foreign labour scheme for us to have a smooth transition,” said ACCCIM president Datuk Ter Leong Yap.

But above all these, lawyers have cast doubt on the legality of the Immigration Department’s move to freeze assets.

The Immigration Act 1959/63, the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLA) 2001 and Passports Act 1966 have been cited to grant such legal powers to the department.

But as Chai correctly pointed out: “People who have power to exercise this ‘nuclear weapon’ have great responsibility. They cannot announce something without clarification.”

Perhaps top policy decision makers of the country will have to interfere in this latest initiative by the Immigration Department. They have to put right what is damaging to the country’s economy.

    1. Program Penggajian dan Penempatan Semula Pendatang Asing Tanpa Izin (PATI) atau Program Rehiring yang telah dilaksanakan bermula pada 15 Februari 2016 akan tamat pada 30 Jun 2016 (Khamis). Oleh yang demikian, Kerajaan menyeru agar para majikan menggunakan tempoh masa yang ada untuk menyertai Program Rehiring bagi membolehkan PATI dikeluarkan permit kerja yang sah.
    2. Berdasarkan penilaian terhadap prestasi Program Rehiring, Kerajaan telah mengambil inisiatif bagi menambahbaik syarat-syarat dan proses pendaftaran dari semasa ke semasa untuk menarik lebih ramai PATI dan majikan mendaftar.

Kerajaan tidak akan teragak-agak mengambil tindakan perundangan terhadap mana-mana majikan yang menggaji PATI selaras dengan kesalahan di bawah Seksyen 55(B) Akta Imigresen 1959/ 63 yang membawa hukuman denda tidak kurang RM10,000 tetapi tidak lebih RM50,000 atau penjara tidak lebih 12 bulan atau kedua-duanya sekali bagi setiap pekerja yang diambil. Pada masa yang sama mana-mana majikan yang mengambil pekerja lebih dari lima orang boleh dikenakan hukuman penjara tidak kurang enam bulan tetapi tidak lebih lima tahun dan boleh dikenakan tidak lebih enam sebatan.

Daftar PATI Sebelum Tarikh Akhir Atau Berdepan Hukuman Sebatan,Daftar PATI Sebelum Khamis, Kerajaan mengingatkan majikan yang menggaji pekerja asing tanpa izin (PATI) di negara ini supaya segera menyertai Program Penggajian dan Penempatan Semula PATI yang akan tamat Khamis ini 31 Dec 2017 (Ahad).

Kementerian Dalam Negeri (KDN) dalam satu kenyataan hari ini, berkata kerajaan tidak akan teragak-agak mengambil tindakan perundangan terhadap mana-mana majikan yang menggaji PATI di bawah Seksyen 55(B) Akta Imigresen 1959/ 63 yang membawa hukuman denda tidak kurang RM10,000 dan tidak lebih RM50,000 atau penjara tidak lebih 12 bulan atau kedua-duanya sekali bagi setiap pekerja yang diambil.

“Pada masa yang sama, mana-mana majikan yang mengambil pekerja lebih daripada lima orang boleh dikenakan hukuman penjara tidak kurang enam bulan tetapi tidak lebih lima tahun dan boleh dikenakan tidak lebih enam sebatan,” katanya dalam satu kenyataan.

KDN memaklumkan, permohonan Program Penggajian dan Penempatan Semula PATI yang mula dilaksanakan sejak 15 Februari lalu hanya boleh dilakukan secara atas talian melalui portal rehiring.imi.gov.my.

“Berdasarkan penilaian terhadap prestasi program ini, kerajaan sudah mengambil inisiatif bagi menambah baik syarat dan proses pendaftaran dari semasa ke semasa untuk menarik lebih ramai PATI dan majikan mendaftar,” katanya

17 Service Sub-Sectors Can Now Recruit Illegal Foreign Workers To Work In Malaysia

A total of 17 sub-sectors in the services sector have been given flexibility to hire illegal foreign workers in Malaysia, says Deputy Home Minister Nur Jazlan Mohamed. Prior to this, only five sub-sectors in the services sector were allowed to do so, namely, cooks, cleaners, resort islands, spas and reflexology and hotels, he said.

The 17 sub-sectors which are given flexibility are shops, theme parks, dhoby, barber, wholesale and retail businesses, textile business, goldsmith, welfare homes, workshop general worker, car wash general worker, market general worker, petrol station mart general worker, hypermarket general worker, mining, mangrove or logging forest, warehouses and cargo at ports.

“Other than giving chance to illegals to work in the sectors, it is also to ease the burden of employers looking for foreign workers,” he told a media conference in Putrajaya today.

Earlier, Nur Jazlan held a meeting with 22 industry and worker association representatives related to the management of foreign workers at the ministry.

He said two service sub-sectors were still not exempted, namely, used items and airport cargo handling on security grounds.

In the meantime, he stressed that illegals who surrendered to the authorities would only be compounded RM300 and given a RM100 special pass to enable them to return home without prosecution.

“The privilege is given due to the government’s concern as the festive season is around the corner. So, those who want to return home must first surrender to the authorities,” said Nur Jazlan.

On an Immigration Department-led operation which ended on May 29, the deputy minister said 25,350 illegals and 529 employers were detained. Of the total number of employers, 34 were charged for various immigration-related offences.

He said to date, the programme to hire illegal immigrants had registered 111,410 illegals, and hoped the number would continue to go up before ending on June 30.

Part of the Rehiring program‘s process is to collecting thumbprint from illegal foreign workers in Malaysia. This was done after employers submitted the application and accepted to legalise their foreign workers. A PATI letter will also issue together with “Registration Slip of Employer / PATI”. The PATI letter come with the QR code to access to online check on worker legalisation status.

Rehiring program updates: The rehiring of illegals foreign worker programme deadline has been revised to Dec 31 2017 due to the poor response from employers. The Home Ministry in a statement said the deadline has been shortened as employers were not responsive to the programme.

“Based on our studies, although the programme has been implemented for almost a month with massive enforcement operations conducted by the Immigration Department, the programme is still at unsatisfactory level as many employers were found to hire illegal foreigners.

“Therefore, the employers are urged to take this opportunity to take part in the programme to enable their illegal foreign workers to obtain valid work permit.

“The government will not hesitate to take legal action against employers who hire illegal foreigners in line with Section 55 (B) of Immigration Act 1959/63,” it said in a statement.

Under the act, those who hire illegal workers are liable to a maximum RM50,000 fine, a maximum jail term of 12 months, or both, for each illegal employee.

In addition, any employers who hire more than five illegal workers will be jailed between six months and five years, and receive up to six strokes of the rotan, if convicted.

The ministry said a total of 15,822 foreign workers were registered under the rehiring programme from Feb 15 to March 10. From the total number, 9,738 were Indonesians, 3,808 Bangladeshis, 425 from Myanmar and 1,851 were from other countries.

The Cabinet has decided to halt the recruitment of new foreign workers supply into the country, said Datuk Seri Ahmad Zahid Hamidi. The Deputy Prime Minister said this also meant that the initial plan to bring in 1.5 million Bangladeshi workers was officially scrapped. The decision would not involve the domestic help or maid sector.

Malaysia is halting the recruitment of new foreign workers into the country with immediate effect, it announced on Saturday (Mar 12, 2016). However, the decision, which was made at a Cabinet meeting on Friday, would not involve the domestic help or maid sector, according to Deputy Prime Minister Ahmad Zahid Hamidi.

Employers who wanted to hire foreign workers should recruit the existing foreign employees in the country, including those whose permits had expired, he added.

This also meant that the country’s initial plan to bring in 1.5 million Bangladeshi workers would be “closed”.

Employers or agents found guilty of protecting illegal foreign workers will be subjected to whipping. “Whipping will be meted out by courts because the punishment with fine has no effect as employers and agents still keep bringing in illegal foreign workers,” said Ahmad Zahid.

He also added that the sentence was meant to dismiss the false allegation that the government was trying to make a profit out of the recruitment process. The government had given ample opportunities for employees to register their foreign workers, he said.

Employers have until Jun 30 to legalise foreign workers. Those who want to hire foreign workers should submit their applications to the Malaysian Employers Federation, Malaysian Trades Union Congress and the Federation of Malaysian Manufacturers, added Ahmad Zahid.

Ahmad Zahid said following this, employers and recruitment agents would be dealt with more severely.

“We will be pushing for those found guilty of trafficking and harbouring illegal workers to be caned.

“Right now, they are not afraid because they think they can get away by paying a fine but that will not be the case anymore,” he said.
