Program Penggajian dan Penempatan Semula Pendatang Asing Tanpa Izin (Program Pemutihan PATI) atau ‘Rehiring’ dan Program Serah Diri Sukarela (3+1) akan tamat pada 31 Disember ini dan tidak akan dilanjutkan. Ketua Pengarah Imigresen, Datuk Seri Mustafar Ali menasihatkan majikan dan pendatang PATI supaya tidak menunggu di saat-saat akhir untuk mendaftar bagi kedua-dua program berkenaan.

“Saya tegaskan selepas tamat sahaja kedua-dua program ini ia tidak akan dilanjutkan.

“Selepas itu pihak jabatan akan meneruskan operasi dan akan berterusan sama seperti operasi yang sedang berjalan sekarang bagi menangkap PATI dan majikan yang gagal mengikuti program pendaftaran PATI,” katanya selepas majlis Perhimpunan Bulanan Jabatan Imigresen di sini hari ini.

Mustafar seterusnya berkata, pihaknya akan mengadakan pertemuan dengan pihak Jabatan Peguam Negara dan Ketua Hakim Negara, Tan Sri Md. Raus Sharif bagi membincangkan berkaitan hukuman dan pendakwaan terhadap PATI. – UTUSAN ONLINE.

Pleas to extend the 3-plus-1 and rehiring programme introduced by the Immigration department for foreign workers will not be entertained when it ends on Dec 31 2017. Director-general Datuk Seri Mustafar Ali stressed employers or immigrants working in the country should not wait until its too late.

“I’m stressing again that there will not be any extension and enforcement will be carried out forcefully to detain those who failed to register,” he said after attending the department’s monthly assembly here today.

This is how the department did to the Enforcement Card or E-card registration programme which was not extended when it expired on June 30, he said.

He stressed ‘Ops Mega’ which was carried out to track down and detain employers and illegal workers who failed to obtain the E-card, will be continued everyday even after Dec 31.

“We will not stop until we register every foreign worker in the country,” he added.

Employers and foreign workers who wished to stay on work in Malaysia must take the registration drive seriously.

“They (illegal foreign workers) must know the consequences of being detained and sent back. Foreign workers will be blacklisted from returning to the country again,” he added.

The rehiring programme was introduced last year when the government had decided to stop the recruitment of new foreign workers.

Illegal foreign workers however can seek to get themselves legalised under the programme which began on Feb 15 2016.

The 3-plus-1 programme, on the other hand is a voluntarily surrendering of illegal workers.

Those who surrendered would be charged a penalty of RM400 instead of paying up to RM5,000 if they were caught by the authorities, Mustafar said.

“Under our 3-Plus-1 programme, they will need to pay a fine of RM400, then buy an air ticket and return to their countries of origin.

“They will also be given a blacklist period which can be up to five years from entering Malaysia,” he added.

Mustafar also said he would meeting the Chief Justice and representatives from Attorney-general Chamber to impose stricter penalties for employers and illegal workers.

Malaysia Detains Illegal Immigrants In Raid On ‘Bangla Market’ In Kuala Lumpur

The Malaysian authorities have detained more Bangladeshis in a drive on a market at Jalan Silang in Kuala Lumpur conducted as part of the ongoing crackdown on illegal immigrants.

The market is known as ‘Bangla Market’ as it is frequented mostly by Bangladeshi workers living in Kuala Lumpur.

A Bangladeshi businessman in the area said the number of detained Bangladeshis would be 50 to 60, including some women.

Malaysian departments of immigration and customs and Kula Lumpur City Corporation jointly conducted the raid for around two and a half hours from 12pm on Saturday.

Kota Roya Bangladeshi Traders’ Association President Rashed Badal told bdnews24.com that the authorities checked whether the businesses at the market were following the laws.

“They have warned us against employing illegal immigrants,” he said.

“They detained 50 to 60 Bangladeshi customers during the drive,” he added.

The Bangladesh High Commission in Kuala Lumpur, however, could not confirm how many Bangladeshis were detained in the raid.

After hundreds of Bangladeshis were detained in the crackdown on illegal immigrants in Malaysia last month, Bangladesh Expatriates’ Welfare and Overseas Employment Minister Nurul Islam said on July 16 that “Malaysia has suspended the crackdown because of the Bangladesh government’s initiative.”

Bangladeshis made up nearly half of the 1,035 foreign nationals detained on July 1, the first day of Malaysia’s crackdown on illegal immigration, according to the local media.

The detainees did not have the necessary enforcement card (e-card) or permits for temporary residence or work, authorities said.

Malaysia’s immigration department had accepted applications for e-cards for four months until Jun 30.

During this time, 26,957 companies applied for e-cards for 155,650 workers from 15 countries.

The majority of applicants were Bangladeshis totalling 71,903.

The Bangladesh High Commission earlier said the e-card grants permission to stay until Feb 15 next year.

This means that those without a valid passport or permission to work may stay and work in Malaysia until Feb 14.

It is possible for the foreign nationals with e-cards to obtain passports and travel documents from their embassies for a new work permit within that time.

Malaysian authorities have warned that those who stay past the deadline will be deported.

According to The Sun Daily, over 600,000 illegal immigrants live in Malaysia, and only 23 percent of them have received e-cards.

Illegal foreign workers with valid employers can come forward to register and legalise their employment under the Immigration Department’s E-kad Malaysia (enforcement card Malaysia) programme.

immigration_dg_Datuk_Seri_Mustafar_AliImmigration Department director-general Datuk Seri Mustafar Ali (pic) said the government made the decision to legalise the employment of foreign workers following high demands from several sectors.

“The registration will be available from Feb 15 at all of our offices in the peninsula and state Immigration departments,” he told a press conference after visiting its Shah Alam headquarters at Kompleks PKNS Shah Alam, on Tuesday.

Registration for the E-kad will be free and it will be valid for a period of one year.

Only five sectors have been approved for the programme, namely, the plantation, agriculture, industrial, construction and services, said Mustafar.

He added that employers can apply for the E-kad between the period of Feb 15 until June 30.

“There will be no extension beyond June 30 and we are firm on this.

“During the one-year period, employers are adviced to apply for their worker’s passport and permits from their respective embassies,” he said.

He also warned employers not to apply to register their foreign workers through any middlemen or agents.

“The employers have to register their foreign workers with the necessary documentations and it will take two days to process,” he said.

He estimated that between 400,000 to 600,000 foreign workers will turn up to register under the programme.

  1. Apakah itu Program E-Kad Sementara Pekerja Asing?

Merupakan suatu inisiafif yang dilancarkan oleh Kerajaan bertujuan untuk member peluang kepada PATI tanpa dokumen perjalanan yang sah dan bekerja secara haram di Malaysia diberikan kad kebenaran bekerja sementara bagi memenuhi sector FORMAL yang dibenarkan.

Program ini turut dirangka untuk memenuhi permintaan majikan untuk mengisi keperluan tenaga kerja di sektor pekerjaan yang dibenarkan sahaja serta membolehkan Kerajaan mengetahui jumlah PATI dalam Negara bagi tujuan pemantauan dan memenuhi keperluan senario keselamatan semasa.

Majikan dan PATI yang telah didaftarkan seterusnya perlu mendapatkan dokumen (Pasport) daripada pihak kedutaan yang berkenaan bagi membolehkan PATI tersebut diputihkan melalui program ini.

  1. Adakah pemegang kad UNHCR boleh mendaftar?

Pelarian yang memegang kad UNHCR tidak boleh mendaftar dalam program ini.

Pendaftaran boleh dibuat di Ibu Pejabat Imigresen Putrajaya dan di semua pejabat Imigresen Negeri mulai 15 Februari 2017 ini.

  1. Berapakah kos yang perlu dibayar bagi Program ini?

Kad ini diberikan secara PERCUMA dan tiada kos pendaftaran dikenakan.

  1. Adakah Program ini akan menggugat keeelamatan dan ketenteraman awam Negara?

Pelaksanaan program ini akan dilakukan dengan berhati-hati dan terkawal supaya tidak berlaku kes-kes penipuan oleh individu-individu yang tidak bertanggungjawab yang cuba mengambil peluang untuk mengaut keuntungan daripada PATI. Bagi tujuan ini, Kerajaan mengenakan syarat-syarat yang ketat terhadap PATI dan Majikan untuk menyertai Program ini serta akan memastikan mana-mana PATI yang tidak Iayak akan dihantar pulang ke Negara asal mengikut prosedur sedia ada iaitu Program 3 +1 bagi memastikan pengurangan lambakan PATI dalam Negara.

  1. Apakah bentuk hukuman yang akan dikenakan jika Majikan masih menggaji PATI secara haram meskipun PATI itu Iayak menyertai Program ini?

Mana-mana Majikan yang didapati menggaji PATI tanpa berdaftar dibawah apa-apa Program yang berkuatkuasa sekarang ini akan dikenakan hukuman yang berat mengikut perundangan sedia ada melibatkan kesalahan menggaji PATI iaitu seperti mana tertakluk di bawah seksyen 55 (B) Akta Imigresen 1959/63 yang mengenakan hukuman denda tidak kurang RM 10,000 tetapi tidak Iebih RM 50,000 atau penjara tidak Iebih 12 bulan atau kedua-duanya sekali.

MyEG’s Contract To Register Malaysia Foreign Workers Extended Till 31 Dec 2017

My EG Services Bhd’s (MyEG) contract to manage the registration of Malaysia illegal foreign workers under the rehiring program has been extended until Dec 31, 2017.

In a filing with Bursa Malaysia, the e-Government services provider said it received a notification letter on Monday from the Home Affairs Ministry regarding the extension. The project was originally scheduled to run from Feb 15, 2016, to Aug 15, 2016.

MyEG said it would be able to register all foreign workers except those from Myanmar.

The company said the project had no fixed value as it depended on the number of illegal foreign workers successfully registered.

“It is expected to contribute positively to the earnings and net assets per share of the group for the financial years ending June 30,  2017 and 2018 respectively.

MyEG said none of the directors and/or major shareholders and persons connected with a director or major shareholder had any interest, direct or indirect, in the project.

Recently the Immigration Department gave MyEG the mandate to provide online renewal of temporary employment pass for foreign workers for a period of five years, backdated to start from May 23, 2015.

Employers of illegal foreign workers can now legalise their employment under the Immigration Department’s E-kad (enforcement card)  programme starting from Feb 15. The registration will be available at all Immigration Department offices in the peninsula.

datuk_mustafar_aliEquipped with a biometric security system, the E-kad registration will be free and valid for one year – until Feb 15, 2018. Department director-general Datuk Seri Mustafar Ali (pic) said employers could apply for the E-kad between Feb 15 and June 30.

“There will be no extension beyond that and we are firm on this,” he told a press conference after visiting its Shah Alam headquarters at Kompleks PKNS Shah Alam yesterday.

Only five sectors are eligible under the programme – plantation, agriculture, industrial, construction and services, said Mustafar.

“The E-kad will function as a temporary confirmation of employment to replace valid travel documents from the respective embassies,” he said.

After registration, em­­plo­­yers are advised to apply for their foreign workers’ passports and permits from their respective embassies as a temporary replacement of valid travel documents, he added.

Mustafar said the decision to legalise the employment of illegal foreign workers – as announced by the Government on Jan 17 – was made to address shortages in several sectors.

“The employers have to register their foreign workers at our offices with the necessary documentation, which will take two days to process,” he said.

Mustafar estimated that between 400,000 and 600,000 foreign workers will turn up to register under the programme.

“For the illegal foreign workers to qualify, they must be employed presently and adhere to the existing rehiring program regulations,” he said.

They must also be from the approved source countries and not have absconded from any employment or failed any health tests, he added.

“The illegal foreign workers registered under the rehiring programme cannot at any time be allowed to change employers (within the period),” he said.

The registration, Mustafar reiterated, can only be done in the peninsula.

As for the employers, he said they must conform to all existing rehiring programme rules, be from the approved sectors and sub-sectors, and not be blacklisted or suspended by the Home Ministry or its one-stop centres.

datuk_seri_mustafar_ali_2“The government made this decision to register all employers who hire foreign workers to address labour shortages in several key economic sectors,” said Immigration Malaysia director-general Datuk Seri Mustafar Ali.

The card will give these workers a one-year extension in the country and will act as a temporary validation for workers before they get their appropriate legal documents from their respective countries or embassies.

“The registration will begin on Feb 15 at all of our offices in the peninsula and state Immigration departments,” he told a press conference after visiting its Shah Alam headquarters at Kompleks PKNS Shah Alam today.

“The registration is free and we will only give them a one-year extension, that’s all, after that we will have to take action if they do not secure a legal status here,” he said.

He said employers must be present with their employees when applying for the E-card and warned employers against applying through middlemen or agents.

“The employers have to register their foreign workers with the necessary documentation and it will take two days to process,” he said.

He estimated that 400,000 to 600,000 foreign workers will turn up to register under the rehiring program.

The announcement by the Malaysia Immigration Department on Tuesday that it would freeze the assets and bank accounts of employers hiring illegal foreign workers has been described as costly and complicated for the business community. This description indicates the severity and unpopularity of this latest decision among business owners. Among the key economic sectors to be affected most by this decision could be plantations, construction, service and manufacturing.

Technically, there is full employment for Malaysians and there is definitely a shortage of labour.

To be enforced next month, this Immigration Department decision has stirred up a huge furore among almost all trade groups, including the Federation of Malaysian Manufacturers and the Associated Chinese Chambers of Commerce and Industry of Malaysia (ACCCIM).

It seems like a hasty and harsh move threatening to shatter the private sector that has helped the country to build up its economy.

Business operators feel that it is the country’s economy that stands to lose if the decision is not reversed.

“There is a necessity for foreign workers in our country, but the system to hire legal workers is costly and complicated,” said lawyer Michael Chai, deputy secretary general II of the ACCCIM.

“The way to resolve it is not to throw a nuclear bomb at the industry.”

Datuk Michael Kang, president of the SME Association of Malaysia, told Nanyang Siang Pau that about 80% of local SMEs will be wiped out if this decision is enforced as almost 80% of local SMEs hire illegal foreigners.

There are about 650,000 SMEs in the country and they form more than 90% of the companies registered in Malaysia.

Kang told The Star: “The Government should legalise all illegal workers. All legal and illegal workers should go for fingerprint imaging so as to monitor them.”

The issue of foreign workers is an age-old problem plaguing the country.

The Government wants Malaysia to be free of illegal immigrants by 2020 and aims to bring down the percentage of foreign labour in the workforce to 15%.
According to ACCCIM deputy secretary-general I Tan Sri Teo Chiang Kok, illegal labourers in Malaysia now total 3.5 million compared with Malaysia’s total population of more than 30 million.

Teo said if the system for the industries to bring in legal foreign workers was easy, the issue of illegal labour would have to be solved “once and for all”.

If we look back, the Government has rolled out many measures to tackle the problem.

Fresh in our minds are the 6P Programme, the “whitening” of illegal migrant workers, and the suspension of recruitment of all foreign workers (which has since been lifted for manufacturing, construction, plantation and furniture-making industries).

With this latest announcement by Immigration, it is clear that the illegal labour issue has yet to be resolved.

The Immigration Department’s decision is yet another knee-jerk policy that only treats the symptoms but not the root cause of the problem, according to Teo, who is involved in property development.

“A lot of times the Government is just putting obstacles and using threatening methods (on us). This is not the way to address the pro­blem,” he said at an ACCCIM press conference on Thursday.

Industry players say they always prefer local and legal workers, given the option.

If the Government’s strategy is to push employers to hire more locals, the current unemployment rate of 3.3% is technically considered full employment.

“This means that there are just not enough local workers to meet the labour demand in our economy,” said Teo.

Indeed, this may not be the right time for the Government to push hard for automation as many SMEs are not prepared amid weak economic conditions.

datuk-ter-leong-yapAccording to the latest survey conducted by ACCCIM on the economic situation of Malaysia for the first half of the year, a total of 14.1% of the respondents were eager to give automation a try to address the difficulty in hiring foreign labour.

However, they said capital shortage, lack of technical know-how and the limitation of a small market in Malaysia were obstacles.

“I believe one day our country will move towards that direction, but we seriously require time.

“We need a good blueprint on the foreign labour scheme for us to have a smooth transition,” said ACCCIM president Datuk Ter Leong Yap.

But above all these, lawyers have cast doubt on the legality of the Immigration Department’s move to freeze assets.

The Immigration Act 1959/63, the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLA) 2001 and Passports Act 1966 have been cited to grant such legal powers to the department.

But as Chai correctly pointed out: “People who have power to exercise this ‘nuclear weapon’ have great responsibility. They cannot announce something without clarification.”

Perhaps top policy decision makers of the country will have to interfere in this latest initiative by the Immigration Department. They have to put right what is damaging to the country’s economy.

The Immigration Department will start freezing the assets of employers who hire and protect illegal foreign workers from next month (October 2016).

datuk_mustafar_aliIts Director-General Datuk Seri Mustafar Ali (pic) said that there is a provision under Section 56(1) of the Immigration Act to freeze assets and bank accounts of employers, however, it has not been fully enforced.

“We don’t want the public to get shocked when we finally take this measure come October this year. It’s not a new thing.

“We hope the media can relay the message to the public so that we can create awareness, as well as inform employers of the consequences they face when they protect their illegal foreign workers,” he said at a press conference here on Tuesday.

Mustafar said the department has also discussed the matter with legal advisers.

“The department is giving employers until the end of this month to sort everything – including their workers’ travel documents, visas and permits,” he said.

On a separate matter, Mustafar said the department would consult with the National Higher Education Fund Corporation, Inland Revenue Board and Malaysian Insolvency Department to help solve the issue of blacklisted Malaysian travellers.

“We would like to suggest to these agencies to come up with a 24-hour help desk at the airport so that they are accessible to the public at all times.

“Although the Immigration Department is reachable at all times, the department is only a gatekeeper and all orders must come from these agencies,” he said.

We do not possess any authority or expertise to solve their issues. “Through this, we hope amicable solutions can be reached and the public’s travel plans would not be disrupted,” he added.
