Malaysia & Nepal Sign Deal To Resume Supply of Nepali Workers to Malaysia

Malaysia and Nepal agreed to resume the stalled process of labor supply from Nepal to Malaysia on Thursday (12/09/2019).

Authorities from the two governments signed a 10-point deal to this effect after the conclusion of a two-day meeting of the Joint Working Group (JWG) held in Kuala Lumpur, the Malaysian capital.

Malaysia was one of the preferred labor destinations for Nepali workers until Nepal Government imposed a ban on its citizens going to Malaysia for jobs fifteen months ago.

The government imposed the ban after its findings that Malaysia-bound workers were forced to pay additional money illegally for a private Malaysian company established in Kathmandu.

According to joint-secretary at Ministry for Labour, Employment and Social Security Ram Prasad Ghimire, who led the Nepali delegation to Malaysia, told Republica Online that the Malaysian government is now ready to address the issue of medical test, which was one of the contesting issues between the two sides.

“We have agreed to resume medical tests through existing 36 health institutions of 122 listed institutions, remaining 86 will be soon approved,” Ghimire said.

Ghimire also informed that the labor pact signed between the two countries last year would be soon implemented.

Based on ToR, Department of Foreign Employment and Nepali Embassy in Malaysia will expedite verification of workers’ demand and labor permit.

Meanwhile, PM KP Oli’s Foreign Relations Advisor Rajan Bhattarai expressed happiness over the latest deal reached between Nepal and Malaysia. “Its a matter of happiness for us that the stalled process of labor supply to Malaysia is going to resume from coming Sunday,” he tweeted.

The Memorandum of Understanding (MoU) on Nepali foreign worker supply signed between Nepal and Malaysia entered into force from Thursday, 12/09/2019.

The MoU covered the following:
Free Visa & Air Ticket
The employers themselves will bear the service tax, cost of two way air ticket, visa surcharge and the cost of medical check-up, security check etc.

Compassionate Leave
The MoU also includes the provision which allows the Nepali workers employed in Malaysia to return home country for a maximum period of 15 days in case of death of his/her close family member (father, mother, husbend or wife, son or daughter)

Accident and Health Insurance
Provisions applicable as per Malaysia’s laws in the case of workers at their workplace would be applicable in the case of Nepali workers as well.

Inform Napali Embassy in case of Causality
A provision has been made requiring the employer to inform the Nepali Embassy in case of injury, mutilation or death of the worker in course of foreign employment. It would be the responsibility of the employer concerned to repatriate the dead body of the worker to Nepal.

Malaysia’s Employment Act 1955
The MoU stated that the Government of Malaysia should provide the same level of protection to the Nepali workers as it provides the workers of other countries working in the same level, in accordance with the Labour Law of Malaysia.

Contract Duration
The new MoU has fixed the contract period of the workers for two (2) years, instead of three (3) earlier on.

Salary Payment Due Date
Provision has also been made for paying the remuneration of the workers within the 7th of every month through the worker’s bank account.

Replacement Scheme For Foreign Workers To Be Reinstated On July 1

The government has agreed to reinstate the foreign workers replacement system to all sectors effective July 1, said Human Resources Minister M. Kula Segaran.

He said the reinstatement of the system would allow employers to get a replacement for a foreign worker who had returned to his home country without having to go through a new application process.

“At the Cabinet meeting on Wednesday, the government approved the reinstatement of the system that was suspended (by the previous government) in 2017. It was an inconvenience to employers who were forced to go through the normal application process and incur further costs to get their replacement workers.

“The government believes this approach will not involve increasing the number of foreign workers but instead retain the number of foreign workers which has been approved for employers before,” he said.

Kula Segaran, who is also the Ipoh Barat Member of Parliament, said this to reporters after a dialogue session with the Perak Chinese Chamber of Commerce and Industry (PCCCI) and the Malaysian Palm Oil Manufacturers Association (POMA) at the Perak PCCCI office here today.

Kula Segaran also said the government’s decision was expected to help resolve the issue of shortage of workers faced by the industry to ensure production of goods, especially those for export, was not affected.

He said employers wishing to apply for replacement of foreign workers should contact the Foreign Workers Management Division of the Ministry of Home Affairs.

Kula Segaran had earlier said that he and Home Minister Tan Sri Muhyiddin Yassin would present to the Cabinet on re-establishing the government’s mechanism for seeking the replacement of foreign workers with other foreign workers.

Termination of Outsourcing Services: Final Reminder To Repatriate Foreign Workers In Accordance with the Government’s Decision To Terminate Outsourcing Services.

The Ministry of Home Affairs (MOHA) has decided to terminate outsourcing services for foreign workers with effect from 31st March 2019. Reference is made to the MOHA directives on management of foreign workers by outsourcing companies dated 15th October 2018, 23rd November 2018, 27th  December 2018, and 18th January 2019.

2. Outsourcing services providers and employers have until 31st March 2019 to repatriate any remaining foreign workers under outsourcing services.

3. In view of this latest policy and regulations on outsourcing services for foreign workers, companies are advised to repatriate their foreign workers with active Temporary Work Visit Pass by 15th  March 2019. The Government’s decision on the matter is final and any appeal will not be considered.

4. Foreign workers with working permits under outsourcing employers who are not involved in the process of changing of employers will be terminated through the system, following which the status of the foreign workers involved will be changed to illegal foreign workers if they still remain in Malaysia.  MOHA has advised that outsourcing employers to comply with the directive and to repatriate their foreign workers within the stipulated period to avoid prosecution under the Immigration Act 1959/1963, and the Private Employment Agency Act (Amended) 2017. MOHA will follow up with further action and enforcement activities upon expiry of the deadline on 31st March 2019.
