The government will be launching the Illegal Immigrant Recalibration Plan encompassing two main components:

a) Return Recalibration Programme and
b) Labour Recalibration Programme (rehiring program / legalisation program)

which would be implemented from Nov 16 2020 to June 30 2021 Dec 31 2021 for illegal immigrants who are in the country.

malaysia_recalibration_pati_programHome Minister Datuk Seri Hamzah Zainudin said the Return Recalibration Programme allows illegal immigrants to return to their country of origin voluntarily, subject to specific stipulated conditions.

The Labour Recalibration Programme regularises illegal immigrants in the country as foreign workers who could be employed by eligible employers subject to stringent conditions determined by the government through the Immigration Department and the Peninsular Malaysia Labour Department (JTKSM), he said.

“We are still freezing new foreign workers to Malaysia and it is still going on.

“The plan is for illegal immigrants in the country who wish to work legally and for those who want to return to their countries of origin to do so. We are giving a period up to June 30,” he said when launching the Illegal Immigrant Recalibration Plan at the Home Ministry here today.

Hamzah said the plan would be implemented by the Immigrant Department with the strategic cooperation of JTKSM as well as other government agencies without involving vendor or third party.

Through this plan, Hamzah said the government is expected to collect RM95 million from compounds and other payments imposed on illegal immigrants and employers.

“In the uncertain economic landscape due to the Covid-19 pandemic, the government would be carrying out strategic assessment on the plan by evaluating the positive and negative effects of its implementation,” he said.

Due consideration would also be given from the aspect of data distribution as well as demography of illegal immigrants in Malaysia for comprehensive enforcement as outlined in the Holistic Plan on Enforcement Against Illegal Immigrant introduced since early this year.

“The data collection of illegal immigrants would be coordinated via information submitted by illegal immigrants and employers during the programme registration,” he said.

Hamzah also gave assurance that the manpower programme offer for illegal immigrants who are in Malaysia would not threaten the market or job opportunities for locals.

“Employment opportunities for local workers are assured subject to the policy on ration of local worker to foreign worker in effect now,” he said and added that the government gives priority to local workers to fill workforce vacancies in all sectors of the economy.

Hamzah said the four sectors namely construction, manufacturing, plantation and agriculture are allowed to employ illegal immigrants during the implementation Illegal immigrant Recalibration Plan.

“For the time being, only employers operating in the four sectors called 3D — dangerous, difficult and dirty are allowed to take in illegal immigrants as workers,” he said, adding that the plan is only for illegal immigrants from 15 countries such as Thailand, Cambodia, Nepal, Myanmar and Bangladesh.

Hamzah said an Illegal immigrant Recalibration Plan Implementation Steering Committee headed by Home Ministry secretary-general Datuk Wan Ahmad Dahlan Abdul Aziz has been set up.

The committee comprises members of various agencies such as the Human Resource Ministry (MOHR), Immigration Department, JTKSM as well as several other related agencies with the role to monitor and regulate the implementation of the Illegal Immigrant Recalibration Plan.

A Special Committee jointly chaired by the Home Minister and Human Resource Minister to discuss foreign worker affairs will meet every three months, he said.

The minister-level Special Committee would also discuss the need to expand the Illegal Immigrant Recalibration Plan to other sectors as well as the policy on expatriates. The first meeting of the committee is scheduled on Dec 3, 2020, he said.

The Home Ministry and MOHR agreed to integrate and share data to manage the affairs of foreign workers including standardising salaries through a joint e-wages system and the matter would be discussed in the ministerial special committee in future, he said.

“Employers should take the opportunity of the plan implementation to register existing illegal immigrants in the country as manpower resources in all sectors of the economy involved,” said Hamzah.

Also present was Human Resource Minister Datuk Seri M Saravanan and Immigration Department director-general Datuk Khairul Dzaimee Daud.

Malaysia MyTravelPass to Help Those Seeking Entry or Exit Permits During Covid-19 Period

The Immigration Department has launched the MyTravelPass system, which will make it easier for Malaysians and foreigners to apply for entry or exit permits during the Covid-19 period. It would reduce the application time to a maximum of five days, said Immigration director-general Datuk Khairul Dzaimee Daud.

“Before this, applications to enter or exit the country by Malaysians and foreigners were done through email.

 “The department has been swamped with between 5,000 and 6,000 emails a day, causing a delay in the applications. We received many complaints from applicants because of this.

“With that, the Immigration Department has taken a proactive step by introducing the MyTravelPass system which uses a ‘single window’. “This will ease the application process, ” Khairul Dzaimee told a press conference yesterday.

Currently, Malaysia’s international borders are closed because of the Covid-19 pandemic and only a select group of categories are exempted, though most of them require prior permission from the Immigration Department.

Among the categories that can be applied for via the MyTravelPass system are entry and exit applications for foreign expatriates and their dependents, permanent residents, Malaysia My Second Home holders and foreign maids. Entry applications for the Singapore Reciprocal Green Lane and the Periodical Commuting Arrangement can also be done through the portal.

Khairul Dzaimee said in the past, it would take up to 10 days for the applications to be processed. “Now it is easier to apply. Of course, the approval is another matter. “Within three to five days, the approval or rejection will be notified, ” he added.

Khairul Dzaimee said the system was developed by the department’s information technology division internally and without using outside funds.

“The people are advised to read and understand the instructions and application procedures before making their application though MyTravelPass, ” he said.

Malaysia Relaxes Entry Ban on Expatriates, Professional Visit Pass Holders From 23 Countries

Malaysia on Thursday (Sept 10) announced that it will allow expatriates and professional visit pass holders from 23 countries to enter, reversing a move on Monday (Sept 7) that was criticised by employers.

To curb the spread of Covid-19, Malaysia had announced that people coming from countries with more than 150,000 cases would be blocked from entering.

The enforced entry ban includes those coming in from the United States, Britain, India and Indonesia.

All foreign tourists have been banned from entry since March.

But Senior Minister (Security Cluster) Ismail Sabri Yaakob said on Thursday that a special Cabinet committee has decided to slightly relax the regulation that was enforced from Monday.

But these expatriates and professional visit pass-holders must first “obtain approval from the (Malaysian) Immigration Department before they can enter the country”, he said.

“Their application must be accompanied by a supporting letter from the Malaysian Investment Development Authority or related agencies, ” he said.

Employers had complained that the government should continue to allow expats and employment pass holders to come in as their technical skills are needed to help the economy.

In another reversal of the ban that started on Monday, Datuk Seri Ismail said the government has also decided to allow permanent residents, as well as foreign spouses of Malaysian citizens, to enter Malaysia from these 23 countries with high infection rates.

But this group can make only a one-way journey into Malaysia and remain in the country.

Student pass holders from the affected countries will also be allowed into Malaysia.

“All categories mentioned must get approval from Immigration beforehand, ” he said.

The 23 countries are the US, Brazil, India, Russia, Peru, Columbia, South Africa, Mexico, Spain, Argentina, Chile, Iran, Bangladesh, United Kingdom, Saudi Arabia, Pakistan, France, Turkey, Italy, Germany, Iraq, the Philippines and Indonesia.

Employers are allowed to rehire foreign workers who were retrenched earlier, but Malaysian workers must be given priority to fill job vacancies.

Human Resources Minister Datuk Seri M. Saravanan said foreign workers could be re-employed in sectors which have not received encouraging response from local workers.

However, the re-employment of foreign workers is subject to certain conditions.

“Only foreign workers who are still in Malaysia, with valid work permits can be re-employed, in the same sector that they had worked previously,” Saravanan said in a statement today.

Employers should also ensure that the foreign workers who they wish to rehire have undergone Covid-19 screening, he said.

He also reiterated figures of retrenched workers in the same statement.

He said as of July this year, the Human Resource Ministry revealed that 67,068 local workers and 4,753 foreign workers have been laid off.

On June 22, Saravanan announced the ministry’s decision to freeze foreign workers’ intake until the end of this year to increase employment opportunities for locals.

However, several private employment agencies responded to that announcement by urging the ministry to review the decision.

Tax relief and deductions

The Malaysian government offers several tax deductions and benefits that expatriate workers who qualify as tax residents are eligible for.

These include:

  • Tax relief for a spouse (so long as the spouse does not earn an income in or out of Malaysia);
  • Tax relief for taxpayers who have to pay parental care;
  • Tax relief for each child below the age of 18; and
  • Tax relief for children studying at the tertiary level.

 

Compliance and payment

In Malaysia, the tax year runs in accordance with the calendar year, beginning on January 1 and ending on December 31. All tax returns must be completed and returned before April 30 of the following year.

To file income tax, an expatriate needs to obtain an income tax number from the LHDN / Inland Revenue Board of Malaysia (IRB). Typically, companies obtain income tax numbers for their foreign expatriates. However, if a company fails to obtain one, the expatriates can register for an income tax number at the nearest IRB office.

If an expatriate makes an incorrect tax return either by omitting or understating their income, the IRB has the right to fine that individual 100 percent of the undercharged tax.

Late income tax submissions may result in a disciplinary fee amounting to a 10 percent increment of the tax payable.

Expatriates working in Malaysia for more than 60 days but less than 182 days are considered non-tax residents and are subject to a tax rate of 30 percent. Foreign expatriates should seek help from registered local tax advisors to better understand their tax liabilities.

Implementation of Additional Facility In ESD Online System: MYENTRY Online System For The Permission of Entry / Exit And Return To Malaysia For Expatriates, And Its Related Passes

As announced by the Government of Malaysia on 18 March 2020, the Government has placed restrictions on Malaysians and non-Malaysians from entering and exiting the country, due to the COVID-19 pandemic. On 26 June 2020, the Government announced that most industries and businesses would be allowed to operate by adhering to a strict set of Standard Operating Procedures (SOP).

During the Movement Control Order (MCO), the Immigration Department of Malaysia (JIM) has outlined the Guidelines for Expatriates for Key Posts & Technical Posts, and for Dependants and Foreign Maids to enter/exit Malaysia which requires permission from the JIM.

New application for Employment Pass still going on. For more information to apply EP category 1 & 2 and PVP, kindly contact us.

To support the Government’s efforts, JIM has developed the MYEntry online system to enhance the current application process. MYEntry is an online platform which enables the public and relevant Government stakeholders, including Malaysian embassies abroad, to apply, process, monitor and track applications in real-time. MYEntry is accessible through the Expatriate Services Division (ESD) online system effective 10 August 2020.

MYEntry will be fully implemented on 17 August 2020. Hence, all applications submitted to taskforce_esd@imi.gov.my before 17 August 2020 which has yet to receive a decision after 14 working days from the date of submission, can be re-submitted via MYEntry.

Malaysia My Second Home (MM2H) Centre at Tourism Ministry Closed

The founder of a group catering to the expatriate community in the country said the Malaysia My Second Home (MM2H) centre in the tourism ministry has been closed “until further notice”, amid talk that 90% of applications for the programme have been rejected.

MM2H is a programme that allows foreigners to stay in Malaysia for a period of 10 years.

Last year, it was reported that the Malaysia My Second Home programme brought in RM40.6 billion in total revenue from the time it was introduced in 2002 until 2018.

Andrew Davison, the CEO of The Expat Group (TEG), said the closure appeared to stem from a “major disagreement between the immigration and tourism ministries about the programme itself”.

Currently, Davison said, no one was allowed to submit any application relating to MM2H visas.

“As regards MM2H visa holders stuck overseas, the MM2H centre has advised me that they will try and approve all the active cases by today,” he said in an email.

Davison said he assumed that approval would now be needed from the Immigration Department director-general.

He went on to say that this put the future of the programme in doubt, claiming that “some people in government” were opposed to it.

Davison said that up until recently, applications for renewal, transfer and new applications were processed by staff in the tourism ministry and later passed to the Immigration Department for stamps to be placed on their passports.

“Now, it is not clear what will happen as there is no place to submit the applications.”

He also said the Immigration Department might want to take over the programme which, in his opinion, would be a bad move.

Davison said a staggering 90% of applications had been rejected, adding that this was unprecedented. “My agency had two rejections which we are confident would have been approved in the past,” he said.

Malaysian Government Has Temporarily Frozen the New Application of MM2H Until Dec 2020

The Malaysian Government has temporarily frozen the new application of Malaysia My Second Home program (MM2H) until December this year. The Malaysian Government will revise the program with the hopes of improving the process flow and simplify the procedures.

President of the Malaysian My Second Home Consultants Association (MM2HCA), Mr Lim Kok Sai say 90% of the MM2H applications they submitted between September and November 2019 were rejected without any reasons or justifications which is much higher than the previous 10 percent rejection rate and also the highest in the past 14 years.

“Our members were shocked when they suddenly received many rejection letters. There were no reasons attached for the rejections and they are not allowed to appeal the decisions. If the applications are rejected, the agents have to return the deposits to the applicants,” MM2HCA president Mr. Lim Kok Sai told the Star.

The scheme, which has brought 40 billion ringgit (HK$76 billion) in revenues for Malaysia, requires applicants to have a minimum deposit of 500,000 ringgit and a monthly income higher than 10,000 ringgit.

Mr. Lim Kok Sai says applications from Hong Kong are not expected to surge following the implementation of the new Hong Kong’s national security law.

Even if the applicant successfully obtains the 10-year residency, they will not acquire Malaysian nationality.

MM2H Matters To Be Handled by Immigration HQ Department From July 6 2020

All immigration matters pertaining to the Malaysia My Second Home (MM2H) programme will be handled by the Immigration Department headquarters here starting July 6.

This was announced by Immigration director-general Datuk Khairul Dzaimee Daud amid reports that the MM2H office in the Tourism, Arts and Culture Ministry (Motac) had been closed and moved to the Immigration Department.

“All immigration matters related to the Malaysia My Second Home programme will be handled at the Immigration Department headquarters in Putrajaya, beginning July 6.

“Only applications to enter Malaysia will still go through Motac.

“All MM2H matters at the Immigration headquarters will fully utilise e-payment (credit/debit cards) transactions, ” said Khairul Dzaimee in a statement.

He also said appointments should be arranged online first at http://sto.imi.gov.my.

“For more information, the public can visit our official website and Facebook page, or call 03-8880 1555 for enquiries, ” he said.

Launched in 2002, the MM2H programme under Motac was aimed at attracting foreigners to invest and migrate to Malaysia.

Since its inception, the government has given approvals to some 48,000 foreigners to reside here under the programme.

MM2H participants enjoy the privilege of a Social Visit Pass, multiple entries over 10 years and renewable visa.

During the movement control order (MCO) lockdown period, many MM2H visa holders were stranded abroad as Malaysia banned entry by foreigners due to the Covid-19 pandemic.

However, MM2H visa holders were allowed to return on May 17, after the government began easing restrictions under the conditional MCO phase.

Expatriate Application For People Republic of China (PRC) passport issued in Wuhan city, Hubei Province of China
