政府料将重启非法外劳漂白计划，以解决各领域员工短缺的问题。

马来西亚中小企业公会总会长拿督江华强透露，该会日前与人力资源部举行一项会议时获悉，政府已原则上同意重启非法外劳漂白计划，人力资源部和内政部正探讨相关细节，一旦敲定，将交由内阁通过，再作出宣布。

他对《南洋商报》说，马来西亚中小企业公会是于早前向人力资源部提出重启非法外劳漂白计划的建议，而相信国内其他工商组织也可能会和当局洽谈此事。

我国今年5月4日落实有条件行动管控指令，重启大部分经济领域后，各行各业复业复工时普遍面对人力不足，尤其是外劳短缺的问题，政府冻结今年杪前引进新外劳，更加剧整个情况。

为解决这个问题，政府日前宣布，聘请不到本地员工而需要外劳的雇主，可以跨领域聘请失业的合法外劳，惟胥视个案处理。

6P计划漂白逾百万人

江华强说，允许雇主跨领域聘请合法外劳后，政府进一步同意漂白非法外劳，将可纾缓各领域外劳短缺的困境。

政府上次推行非法外劳漂白计划是2011年，当时称6P非法外劳漂白计划，是于当年8月1日开跑，为国内200万名非法外劳展开漂白，并于2012年4月10日结束。

此外，前朝国阵政府2014年杪宣布延长6P非法外劳漂白计划下外劳多一年的工作期限，并于2016年2月15日启动“重雇非法外劳计划”，共有多达74万4942名非法外劳，以及8万3919名雇主在有关计划下登记。

前朝希盟政府2018年5月上台后，宣布“重雇非法外劳计划”于当年6月30日结束，移民局从该年7月1日开始展开大规模行动，打击非法外劳。

获特赦者印尼最多

政府2011年8月1日至2012年4月10日推行的6P外劳漂白计划，成功为39万3358名非法外劳漂白，成为7万6795名名雇主的合法外劳，投身领域包括工厂、服务业、建筑、园丘及农业等。

获得特赦的各国外劳中，以印尼最多（7万9565人），接下来是印度（9829人）及尼泊尔（8743人）。另有12万7503名非法外劳选择回国。

政府在6P外劳漂白计划下，于2011年9月1日至2012年4月10日间，共征抽15亿3301万1507令吉55仙的人头税。

Employers are allowed to rehire foreign workers who were retrenched earlier, but Malaysian workers must be given priority to fill job vacancies.

Human Resources Minister Datuk Seri M. Saravanan said foreign workers could be re-employed in sectors which have not received encouraging response from local workers.

However, the re-employment of foreign workers is subject to certain conditions.

“Only foreign workers who are still in Malaysia, with valid work permits can be re-employed, in the same sector that they had worked previously,” Saravanan said in a statement today.

Employers should also ensure that the foreign workers who they wish to rehire have undergone Covid-19 screening, he said.

He also reiterated figures of retrenched workers in the same statement.

He said as of July this year, the Human Resource Ministry revealed that 67,068 local workers and 4,753 foreign workers have been laid off.

On June 22, Saravanan announced the ministry’s decision to freeze foreign workers’ intake until the end of this year to increase employment opportunities for locals.

However, several private employment agencies responded to that announcement by urging the ministry to review the decision.

Malaysia Personal Income Tax Guide For Expatriate Employment Pass Visa Holders

Tax relief and deductions

The Malaysian government offers several tax deductions and benefits that expatriate workers who qualify as tax residents are eligible for.

These include:

  • Tax relief for a spouse (so long as the spouse does not earn an income in or out of Malaysia);
  • Tax relief for taxpayers who have to pay parental care;
  • Tax relief for each child below the age of 18; and
  • Tax relief for children studying at the tertiary level.

 

Compliance and payment

In Malaysia, the tax year runs in accordance with the calendar year, beginning on January 1 and ending on December 31. All tax returns must be completed and returned before April 30 of the following year.

To file income tax, an expatriate needs to obtain an income tax number from the LHDN / Inland Revenue Board of Malaysia (IRB). Typically, companies obtain income tax numbers for their foreign expatriates. However, if a company fails to obtain one, the expatriates can register for an income tax number at the nearest IRB office.

If an expatriate makes an incorrect tax return either by omitting or understating their income, the IRB has the right to fine that individual 100 percent of the undercharged tax.

Late income tax submissions may result in a disciplinary fee amounting to a 10 percent increment of the tax payable.

Expatriates working in Malaysia for more than 60 days but less than 182 days are considered non-tax residents and are subject to a tax rate of 30 percent. Foreign expatriates should seek help from registered local tax advisors to better understand their tax liabilities.

Implementation of Additional Facility In ESD Online System: MYENTRY Online System For The Permission of Entry / Exit And Return To Malaysia For Expatriates, And Its Related Passes

As announced by the Government of Malaysia on 18 March 2020, the Government has placed restrictions on Malaysians and non-Malaysians from entering and exiting the country, due to the COVID-19 pandemic. On 26 June 2020, the Government announced that most industries and businesses would be allowed to operate by adhering to a strict set of Standard Operating Procedures (SOP).

During the Movement Control Order (MCO), the Immigration Department of Malaysia (JIM) has outlined the Guidelines for Expatriates for Key Posts & Technical Posts, and for Dependants and Foreign Maids to enter/exit Malaysia which requires permission from the JIM.

New application for Employment Pass still going on. For more information to apply EP category 1 & 2 and PVP, kindly contact us.

To support the Government’s efforts, JIM has developed the MYEntry online system to enhance the current application process. MYEntry is an online platform which enables the public and relevant Government stakeholders, including Malaysian embassies abroad, to apply, process, monitor and track applications in real-time. MYEntry is accessible through the Expatriate Services Division (ESD) online system effective 10 August 2020.

MYEntry will be fully implemented on 17 August 2020. Hence, all applications submitted to taskforce_esd@imi.gov.my before 17 August 2020 which has yet to receive a decision after 14 working days from the date of submission, can be re-submitted via MYEntry.

馬來西亞旅遊、藝術及文化部長舒克里（Datuk Seri Nancy Shukri）周四（2日）宣布，政府正重新審視及改善MM2H，已暫停所有申請，料持續至2020年12月。

舒克里表示，旅遊、藝術及文化部會審視MM2H，入境部門則會研究申請批准程序，目的是改善計劃，預計年底完成。她指，MM2H對國家經濟有貢獻，不會永久凍結申請，明年會恢復計劃。

MM2H全國顧問協會總會長林國獅透露，去年9月至11月有90%的申請被政府無理拒絕，又不准申請人上訴，250間成員企業對收到大量拒絕信感震驚。他指出，過往的拒絕率大約是10%，而且申請人可以上訴。

根據MM2H安排，年滿21歲或以上的外籍人士可申請10年可續期的居留簽證，取得簽證後仍可保留原有國籍。按申請人的年齡差別，所需資金亦有所不同，50歲以下人士需備有一筆50萬馬元（約95.2萬港元）流動資產證明；50歲以上人士則需備一筆35萬馬元（約66.6萬港元）流動資產證明。

Malaysia My Second Home (MM2H) Centre at Tourism Ministry Closed

The founder of a group catering to the expatriate community in the country said the Malaysia My Second Home (MM2H) centre in the tourism ministry has been closed “until further notice”, amid talk that 90% of applications for the programme have been rejected.

MM2H is a programme that allows foreigners to stay in Malaysia for a period of 10 years.

Last year, it was reported that the Malaysia My Second Home programme brought in RM40.6 billion in total revenue from the time it was introduced in 2002 until 2018.

Andrew Davison, the CEO of The Expat Group (TEG), said the closure appeared to stem from a “major disagreement between the immigration and tourism ministries about the programme itself”.

Currently, Davison said, no one was allowed to submit any application relating to MM2H visas.

“As regards MM2H visa holders stuck overseas, the MM2H centre has advised me that they will try and approve all the active cases by today,” he said in an email.

Davison said he assumed that approval would now be needed from the Immigration Department director-general.

He went on to say that this put the future of the programme in doubt, claiming that “some people in government” were opposed to it.

Davison said that up until recently, applications for renewal, transfer and new applications were processed by staff in the tourism ministry and later passed to the Immigration Department for stamps to be placed on their passports.

“Now, it is not clear what will happen as there is no place to submit the applications.”

He also said the Immigration Department might want to take over the programme which, in his opinion, would be a bad move.

Davison said a staggering 90% of applications had been rejected, adding that this was unprecedented. “My agency had two rejections which we are confident would have been approved in the past,” he said.

第二家園全國顧問協會總會長林國獅披露，超過90%的申請被當局拒絕，這是14年以來，首次出現大量申請不獲批。第二家園計劃從2002年推出至今，以中國人申請居多，其次是日本、孟加拉、英國和韓國等，為大馬帶來400億令吉（760億港元）的收入。

这次马来西亚政府重新審視第二家園計劃凍結申請至2020年底。馬來西亞旅遊、藝術及文化部長南茜透露，第二家園（MM2H）新申請暫時被凍結，因為政府正對有關計劃程序重新進行審視。預計會在今年12月或更久完成，此次審視旨在改善第二家園計劃和批准程序。

她指出，第二家園計劃有助提升國家經濟，因此政府不會取消有關計劃，第二家園中心停止運作只是暫時性，並非是永久性關閉。該計劃應該會在明年恢復。她指出，大馬因封鎖邊境，導致旅遊業處於停滯階段，而要改進第二家園還有很多工作要做。

香港人要留意，計劃要求申請者最少要有50萬令吉（約90萬港元）的存款，申請時月薪也要高於1萬令吉（約1.8萬港元）。即使申請人成功獲批10年居住權，仍可保留原來國籍，但不代表可以成為馬來西亞公民，不會獲得馬來西亞國籍。

Malaysian Government Has Temporarily Frozen the New Application of MM2H Until Dec 2020

The Malaysian Government has temporarily frozen the new application of Malaysia My Second Home program (MM2H) until December this year. The Malaysian Government will revise the program with the hopes of improving the process flow and simplify the procedures.

President of the Malaysian My Second Home Consultants Association (MM2HCA), Mr Lim Kok Sai say 90% of the MM2H applications they submitted between September and November 2019 were rejected without any reasons or justifications which is much higher than the previous 10 percent rejection rate and also the highest in the past 14 years.

“Our members were shocked when they suddenly received many rejection letters. There were no reasons attached for the rejections and they are not allowed to appeal the decisions. If the applications are rejected, the agents have to return the deposits to the applicants,” MM2HCA president Mr. Lim Kok Sai told the Star.

The scheme, which has brought 40 billion ringgit (HK$76 billion) in revenues for Malaysia, requires applicants to have a minimum deposit of 500,000 ringgit and a monthly income higher than 10,000 ringgit.

Mr. Lim Kok Sai says applications from Hong Kong are not expected to surge following the implementation of the new Hong Kong’s national security law.

Even if the applicant successfully obtains the 10-year residency, they will not acquire Malaysian nationality.

90%馬来西亚第二家园申请被拒，林国狮促政府解释供改进

第二家園計劃 2020年最新消息：马来西亚自去年收紧第二家园计划，加上冠病疫情实行行管令，估计90％申请被拒绝，马来西亚我的第二家园全国顾问协会（MM2HCA）总会长林国狮促请政府给予合理的理由。

盼推迟提高申请门槛

林国狮也听说政府将会把申请门槛提高，包括调整定期存款及其他方面的条件。他促请政府暂时推迟有关修改，直到冠病疫情好转，人民生活恢复正常后才实行。

林国狮今日召开新闻发布会指出，大马旅游及文化部（MOTAC）于今年5月25日起，拒绝了约1000份（90％）的MM2H申请，并且没有解释拒绝的理由。

他说，“如果申请被拒绝，我们（第二家园顾问公司）必须将钱或预付款项退还给申请人。

“这次政府拒绝了大多数申请，让我们这些公司陷入严重的财务困境，可能导致员工失业及公司倒闭。”

“政府如果可以解释拒绝申请的理由，让我们知道哪里出现问题，让我们可以去改进再重新申请。”

国家料损失逾7亿

他指这次拒绝90％的申请，估计将使我国损失7.76亿令吉，严重影响第二家园计划及其他相关行业。

他说，“根据我们2018年的数据统计，当时批准了5610个申请，并至少把44.4亿令吉带入国内。”

“很多外国人因为我国的教育、医疗、及气候因素，申请第二家园计划。但不代表他们将永久移民到我国，还有部分人士是自己国家天气太冷，每年3个月来到我国避寒，而申请这项计划。”

港国安法生效， 申请MM2H港人不会激增

另外，林国狮对本报说，香港国安法生效后，申请马来西亚第二家园计划（MM2H）的香港人不会突然激增。

他说：“香港申请者向来都是占前五名，从2017年起便不断增加，可能与当地仲介大力介绍有关，但香港申请者只是占很小的比率。”

根据数据，2017年全年，有6195名来自世界各国与地区的居民提出申请MM2H，来自香港的申请则有339人。

港人移民地选择多

林国狮说，申请MM2H的港人不多，可能港人可以移民定居的国家与地区选择繁多。

“我们推测，虽然落实了国安法，香港人的申请不会突然增加，毕竟有能力的、符合MM2H申请条件者，大多都已经提出了申请，年轻人不符合条件。”

旅游部MM2H中心关闭整合

此外，林国狮指出，原本处于旅游部的MM2H中心已暂时性关闭，并搬迁至布城移民局总部，只是为了整合资源和简化申请程序。

移民局总监拿督凯鲁今日发表文告说，从7月6日起到，所有和MM2H相关事务的手续，将在布城移民局总部办理，但依然得向旅游部提出MM2H入境申请。

MM2H Matters To Be Handled by Immigration HQ Department From July 6 2020

All immigration matters pertaining to the Malaysia My Second Home (MM2H) programme will be handled by the Immigration Department headquarters here starting July 6.

This was announced by Immigration director-general Datuk Khairul Dzaimee Daud amid reports that the MM2H office in the Tourism, Arts and Culture Ministry (Motac) had been closed and moved to the Immigration Department.

“All immigration matters related to the Malaysia My Second Home programme will be handled at the Immigration Department headquarters in Putrajaya, beginning July 6.

“Only applications to enter Malaysia will still go through Motac.

“All MM2H matters at the Immigration headquarters will fully utilise e-payment (credit/debit cards) transactions, ” said Khairul Dzaimee in a statement.

He also said appointments should be arranged online first at http://sto.imi.gov.my.

“For more information, the public can visit our official website and Facebook page, or call 03-8880 1555 for enquiries, ” he said.

Launched in 2002, the MM2H programme under Motac was aimed at attracting foreigners to invest and migrate to Malaysia.

Since its inception, the government has given approvals to some 48,000 foreigners to reside here under the programme.

MM2H participants enjoy the privilege of a Social Visit Pass, multiple entries over 10 years and renewable visa.

During the movement control order (MCO) lockdown period, many MM2H visa holders were stranded abroad as Malaysia banned entry by foreigners due to the Covid-19 pandemic.

However, MM2H visa holders were allowed to return on May 17, after the government began easing restrictions under the conditional MCO phase.
