Program Rehiring Update: Program Penggajian Dan Penempatan Semula Pendatang Asing Tanpa Izin (PATI) atau Program Rehiring Akan Tamat Pada 30 Jun 2016 (Khamis) 31 December 2017 (Ahad)

    1. Program Penggajian dan Penempatan Semula Pendatang Asing Tanpa Izin (PATI) atau Program Rehiring yang telah dilaksanakan bermula pada 15 Februari 2016 akan tamat pada 30 Jun 2016 (Khamis). Oleh yang demikian, Kerajaan menyeru agar para majikan menggunakan tempoh masa yang ada untuk menyertai Program Rehiring bagi membolehkan PATI dikeluarkan permit kerja yang sah.
    2. Berdasarkan penilaian terhadap prestasi Program Rehiring, Kerajaan telah mengambil inisiatif bagi menambahbaik syarat-syarat dan proses pendaftaran dari semasa ke semasa untuk menarik lebih ramai PATI dan majikan mendaftar.
    3. Kerajaan tidak akan teragak-agak mengambil tindakan perundangan terhadap mana-mana majikan yang menggaji PATI selaras dengan kesalahan di bawah Seksyen 55(B) Akta Imigresen 1959/ 63 yang membawa hukuman denda tidak kurang RM10,000 tetapi tidak lebih RM50,000 atau penjara tidak lebih 12 bulan atau kedua-duanya sekali bagi setiap pekerja yang diambil. Pada masa yang sama mana-mana majikan yang mengambil pekerja lebih dari lima orang boleh dikenakan hukuman penjara tidak kurang enam bulan tetapi tidak lebih lima tahun dan boleh dikenakan tidak lebih enam sebatan.

Daftar PATI Sebelum Tarikh Akhir Atau Berdepan Hukuman Sebatan,Daftar PATI Sebelum Khamis, Kerajaan mengingatkan majikan yang menggaji pekerja asing tanpa izin (PATI) di negara ini supaya segera menyertai Program Penggajian dan Penempatan Semula PATI yang akan tamat Khamis ini 31 Dec 2017 (Ahad).

Kementerian Dalam Negeri (KDN) dalam satu kenyataan hari ini, berkata kerajaan tidak akan teragak-agak mengambil tindakan perundangan terhadap mana-mana majikan yang menggaji PATI di bawah Seksyen 55(B) Akta Imigresen 1959/ 63 yang membawa hukuman denda tidak kurang RM10,000 dan tidak lebih RM50,000 atau penjara tidak lebih 12 bulan atau kedua-duanya sekali bagi setiap pekerja yang diambil.

“Pada masa yang sama, mana-mana majikan yang mengambil pekerja lebih daripada lima orang boleh dikenakan hukuman penjara tidak kurang enam bulan tetapi tidak lebih lima tahun dan boleh dikenakan tidak lebih enam sebatan,” katanya dalam satu kenyataan.

KDN memaklumkan, permohonan Program Penggajian dan Penempatan Semula PATI yang mula dilaksanakan sejak 15 Februari lalu hanya boleh dilakukan secara atas talian melalui portal rehiring.imi.gov.my.

“Berdasarkan penilaian terhadap prestasi program ini, kerajaan sudah mengambil inisiatif bagi menambah baik syarat dan proses pendaftaran dari semasa ke semasa untuk menarik lebih ramai PATI dan majikan mendaftar,” katanya

17 Service Sub-Sectors Can Now Recruit Illegal Foreign Workers To Work In Malaysia

A total of 17 sub-sectors in the services sector have been given flexibility to hire illegal foreign workers in Malaysia, says Deputy Home Minister Nur Jazlan Mohamed. Prior to this, only five sub-sectors in the services sector were allowed to do so, namely, cooks, cleaners, resort islands, spas and reflexology and hotels, he said.

The 17 sub-sectors which are given flexibility are shops, theme parks, dhoby, barber, wholesale and retail businesses, textile business, goldsmith, welfare homes, workshop general worker, car wash general worker, market general worker, petrol station mart general worker, hypermarket general worker, mining, mangrove or logging forest, warehouses and cargo at ports.

“Other than giving chance to illegals to work in the sectors, it is also to ease the burden of employers looking for foreign workers,” he told a media conference in Putrajaya today.

Earlier, Nur Jazlan held a meeting with 22 industry and worker association representatives related to the management of foreign workers at the ministry.

He said two service sub-sectors were still not exempted, namely, used items and airport cargo handling on security grounds.

In the meantime, he stressed that illegals who surrendered to the authorities would only be compounded RM300 and given a RM100 special pass to enable them to return home without prosecution.

“The privilege is given due to the government’s concern as the festive season is around the corner. So, those who want to return home must first surrender to the authorities,” said Nur Jazlan.

On an Immigration Department-led operation which ended on May 29, the deputy minister said 25,350 illegals and 529 employers were detained. Of the total number of employers, 34 were charged for various immigration-related offences.

He said to date, the programme to hire illegal immigrants had registered 111,410 illegals, and hoped the number would continue to go up before ending on June 30.

Malaysia Contractors Face Serious Labour Shortage

About 10,000 contractors affiliated to the United Malaysia Contractors Association are facing a serious labour shortage as a result of the freeze on the hiring of new foreign workers. Some of them have to make their workers work for up to 16 hours a day, Nanyang Siang Pau reported today.

The association’s members are mostly small and medium contractors who, in order to meet project deadlines, are forced to fork out high overtime wages to keep their workers toiling beyond the normal hours.

The association deems the situation unhealthy as working long hours over the long term would give rise to health and safety issues.

The association’s second vice-president, Liang Gan Qiang, told the daily that as Malaysians were reluctant to work at construction sites, its members were forced to hire foreign workers.

He disclosed that in the past, Indonesians made up the bulk of this workforce but the situation had changed and most of the workers involved in small and medium construction projects now were Bangladeshis.

Liang said these Bangladeshis worked not only up to 16 hours a day but also on Sunday at times, when given the chance, so as to send more money home.

“They are taking home thousands of ringgit a month, several times more than the minimum wage mandated by the government,” he said.

Liang urged the government to rethink the “freeze on hiring of new foreign workers” policy, saying it had already affected thousands of small and medium contractors in the country.

He said the rule to bar foreign workers from being hired for more than five years would cause a “drain of skilled workers”.

He explained that the majority of these workers were untrained when they were brought in and it would take years for them to become skilled workers.

RAM Ratings: Freeze On Malaysia Foreign Workers Intake A Risk

According to RAM Ratings, the current freeze on the hiring of foreign workers will largely affect the construction and plantation industries as these industries largely rely on foreign labours, reported The Sun Daily. “Even though the program rehiring of existing foreign workers may help for a short-term, new supplies are needed in a long run to replace those who have decided to return home. These industries will start to suffer if the freeze is extended further,” it said.

The rating agency did not expect the recent foreign labours levy hike to give much impact on this, as the hike was substantially lower than the amount that was initially proposed by the government in January 2016.

Initially, a hike of 10% increase in labour cost and 2% rise in overall cost was suggested. But the labour cost was increased by 5% and the overall cost was increased by 1%, half of what was suggested before.

In March 2016, the foreign workers levy was increased to RM1,850 per worker from RM1,250. At the moment, the government has announced that the freeze on hiring foreign workers will remain.

13,795 PATI Ditahan Imigresen

Seramai 13,795 pendatang asing tanpa izin (PATI) ditahan dalam siri operasi penguatkuasaan oleh Jabatan Imigresen Malaysia di seluruh negara sejak Januari sehingga 21 Mac lalu.

Ketua Pengarah Imigresen, Datuk Sakib Kusmi berkata, sepanjang tempoh itu, sebanyak 2,613 operasi dijalankan di pelbagai lokasi seperti di kawasan rumah kongsi, tapak pembinaan dan premis perniagaan.

Menurut beliau, pasukannya telah memeriksa seramai 46,189 warga asing dan menahan 13,795 daripada mereka kerana me­lakukan pelbagai kesalahan.

Daripada jumlah itu, Sabah merupakan negeri yang pa­ling ramai PATI ditahan iaitu seramai 2,107 orang dan diikuti Wilayah Persekutuan Kuala Lumpur (1,895), Johor (1,867), Wilayah Persekutuan Putrajaya (1,620), Melaka (1,064) dan selebihnya di negeri-negeri lain.

“Semua mereka ini ditahan dalam operasi berjadual Jabatan Imigresen termasuk juga serbuan berdasarkan aduan orang ramai.

“Antara kesalahan yang sering dilakukan ialah tiada dokumen pengenalan diri, tinggal lebih masa, dokumen palsu dan pemegang kad yang tidak diiktiraf serta lain-lain kesalahan,” katanya ketika dihubungi Kosmo! semalam.

Undocumented Filipinos in Malaysia are encouraged to take advantage of the Malaysian government’s ongoing Rehiring Program in order for them to secure valid work permits, the Philippine Embassy said Wednesday. Concerned Filipinos have until June 30, 2016 to avail of the program at Peninsular Malaysia, according to Ambassador J. Eduardo Malaya in a statement.

Filipinos qualified for the program are those who entered Malaysia through a regular airport or port of entry, who have no criminal records, and have worked with the same employer for the last six months.

Overstaying Filipinos with visit pass temporary employment (VPTE or employment visas) while working with the same employer or who entered Malaysia under social visit passes (SVP or tourist visas) are also qualified to apply.

Filipinos who have overstayed with employment visas but with a different employer are also qualified, the embassy said.

Malaya said qualified Filipino workers must have a valid passport, pass the Foreign Workers’ Medical Examination Monitoring Agency’s medical exams, and pay the levy according to the sector they choose to enter.

Filipinos applying for the program may choose to enter the construction, manufacturing, services, agriculture, and plantation sectors.

Rehiring program updates: The rehiring of illegals foreign worker programme deadline has been revised to Dec 31 2017 due to the poor response from employers. The Home Ministry in a statement said the deadline has been shortened as employers were not responsive to the programme.

“Based on our studies, although the programme has been implemented for almost a month with massive enforcement operations conducted by the Immigration Department, the programme is still at unsatisfactory level as many employers were found to hire illegal foreigners.

“Therefore, the employers are urged to take this opportunity to take part in the programme to enable their illegal foreign workers to obtain valid work permit.

“The government will not hesitate to take legal action against employers who hire illegal foreigners in line with Section 55 (B) of Immigration Act 1959/63,” it said in a statement.

Under the act, those who hire illegal workers are liable to a maximum RM50,000 fine, a maximum jail term of 12 months, or both, for each illegal employee.

In addition, any employers who hire more than five illegal workers will be jailed between six months and five years, and receive up to six strokes of the rotan, if convicted.

The ministry said a total of 15,822 foreign workers were registered under the rehiring programme from Feb 15 to March 10. From the total number, 9,738 were Indonesians, 3,808 Bangladeshis, 425 from Myanmar and 1,851 were from other countries.

10,239 Foreign Workers Registered Under Rehiring Program As At 29 Feb 2016

A total of 10,239 foreign workers were registered by 2,210 employers under the Rehiring Program since Feb 15 until Feb 28. Deputy Home Minister Datuk Nur Jazlan Mohamed however was not satisfied with the number.

“It is very low. To say they face difficulties signing up is not justified because it can done online and they need not have to go to the immigration office or company to register the illegal immigrants,” he told reporters after presenting the Immigration Department 2015 excellent service awards to 813 recipients here today.

He said employers who were not IT savvy could visit the immigration branches for advisory service.

The Rehiring Programme up to December 31 is to provide opportunities for illegals from 15 source countries working illegally in the country to be granted valid work permits to meet the permitted employment sector.

He said the registration fee of RM800 under the Rehiring Programme was reasonable and fair and took into account the various costs incurred by the government following the entry of foreign workers, including the costs of health, safety, detention and deportation.

“To me it is a fair trade off, you want foreign workers you pay for it,” he said, adding that the registration fee in Malaysia was much lower compared to other countries like Singapore and Middle East that used a large number of foreign workers.

Foreign Workers Found Without Valid Papers During Joint Operation At Wholesale Market

A TOTAL of 72 foreign workers were detained for not possessing valid documents during a joint operation at the Kuala Lumpur wholesale market. The operation by 77 officers from Kuala Lumpur City Hall (DBKL), Kuala Lumpur Immigration Department and the police conducted checks on foreign workers’ travel documents, working permits as well as United Nations High Commission for Refugees (UNHCR) cards.

DBKL Licence and Petty Traders Management Department senior assistant director Saiful Mazli said DBKL would continue to have such operations in the future to better monitor the foreign workers in the market.

“This is part of our efforts to better manage the market and monitor the foreign workers.

“We want to ensure all foreigners working here are registered but this will take some time,” he said, adding that the large population of foreigners here contributed to the problem.

“There are fewer foreign workers here today and I see some improvement.

“We hope the wholesalers here will give us their cooperation and abide by the law.

“It is also the employer’s responsibility to check the travel documents of their foreign workers frequently,” Saiful said, adding that they might conduct similar operations at least twice a week.

StarMetro reported yesterday that foreigners without a tag and uniform would not be permitted to enter the market.

Only those in colour-coded uniforms and tags worn by wholesalers and their registered foreign workers will be allowed into the market, besides local customers.

During the operation, StarMetro noticed that there were workers who did not wear the uniforms and tags.

Foreign workers who did not wear the uniforms or tags and those caught without possessing any valid working or travel documents were taken to the entrance of the market for further checks.

Kuala Lumpur Immigration Department representative Muhamad Faisal Abu Bakar, who led the operation, said some of them were suspected to have falsified their work permits and travel documents.

“We also found some of them had misused their working permit, did not have proper identification or their travelling period here had expired.

“The detained foreign workers were brought to the lock-up at the Immigration Department at Jalan Duta for further investigation and action will be taken accordingly if they were found breaking the law,” he said.

Out of the 122 foreign workers who were round-up at the market entrance, 50 were released after their documents were verified.

Some of the wholesalers who witnessed the entire operation said they supported the action by the authorities.

Local vegetable seller Elaine Shum, 43, said DBKL should conduct such operations once in a while to keep the foreign workers in check.

“Sometimes, there are just too many foreign workers here.

“I have seen foreign workers fighting with each other and I suspect they are not registered workers.

“This paints a bad image to some of the foreign workers who are really hardworking,” she said.

She added that the operation was timely as it was done during off-peak hours.

“We get busy around 3pm and we need the foreign workers to help,” she said.

Another vegetable seller, Lim Chee Leong, 33, said the operation would act as a warning to other unregistered foreigners operating here.

“It is good that they weed out the unregistered foreign workers.

“I hope this will scare off those selling vegetables at the parking lot as it affects our business here,” he said.
